I want to clarify something about my position on all of this. I think ChudTheBuilder is a fucking moron for doing any of this. I understand why he’s doing it but expecting that violence is not eventually going to happen is a fool’s errand. I suppose the jury is still out on whether Chud is seeking out stardom or trying to bring attention to a very serious problem in this country about offensive words and the importance of the first amendment. That said, the number of people in these replies that condone violence as a proper response to the use of offensive language is astounding. Education all around is what seems to be in order here. This is a really big problem and it’s going to end poorly if we continue to push the extremes on both ends of this spectrum.

ChudTheBuilder shot a man who attacked him outside a courthouse in Clarksville & accidentally grazed himself in the process. Before it escalated, he asked the man if he was going to “chimp out” the man then walked up & sucker punched him. It is unclear if the man survived.

As they should. The real tragedy isn’t the higher freight rates, it’s the ~5,000 families shattered every year in large-truck crashes (mostly other drivers/passengers hit by multi-ton rigs). FMCSA data shows carriers with poor safety ratings (bad CSA scores, weak driver quals) have 2-3x higher crash risk. This unanimous SCOTUS ruling just stopped brokers from cherry-picking the cheapest, sketchiest outfits and forces them to book the safer ones. Costs go up short-term? Yes. But safer highways mean fewer ‘families of four pummeled’ long-term. Self-driving rigs will help eventually (Aurora/Kodiak already running limited driverless loads in TX/AZ), but this accountability matters now.

@PTrubey @FreightAlley @samosaur Because 30% of brokers would have to find new contracts. Contracts with companies that that wouldn’t even remotely entertain the notion of bringing these brokers on or doing business with them at all. You think the shoddy practices start and end with only hiring?

Respectfully, Gann v. State (1964) is a poor fit here and doesn’t survive scrutiny. In that case, the defendant showed up uninvited at a private home, refused to leave when the owner told him to, escalated the confrontation on their property, and fired first. This incident happened on a public sidewalk outside the courthouse, a place Eatherly had every legal right to be. Provocative words (even ugly ones) are protected speech. They don’t legally justify someone punching you first under Tennessee law (§ 39-11-611). That’s not a minor detail; it’s the central distinction between “initial aggressor” and lawful self-defense in a stand-your-ground state. The facts matter.

@KennethRWebster Hung jury. Unless he has a Derek Chauvin jury. Attacking someone over "fightin' words" is not legal self-defense. On the other hand, using a weapon in response to someone attacking you is very legal.

Respectfully, that’s a common misunderstanding of the law. There is no legal standard anywhere in the USA, federal, state, or local, that justifies using physical force simply because someone used offensive words. Tennessee law (and every other state) is crystal clear: “words alone, no matter how insulting, do not justify a battery.” The punch made him the initial aggressor. Chud was then legally entitled to defend himself in a stand-your-ground state. Provocation by speech might affect civil damages or, in extreme homicide cases, reduce a charge to manslaughter, but it never excuses throwing the first punch. Words don’t give anyone a free pass to assault someone.

Respectfully, the Founders chose “during good Behaviour” tenure for SCOTUS for a very good reason. Hamilton in Federalist 78 called it “the best expedient… to secure a steady, upright, and impartial administration of the laws” and an essential “barrier to the encroachments and oppressions of the representative body.” Elected justices or term limits would destroy that independence and turn judges into politicians in robes, chasing votes, donors, or their next job instead of the Constitution. That’s precisely what the Framers designed the judiciary to avoid. Impeachment is the check for misconduct. This isn’t a bug. It’s the feature that protects constitutional government from momentary majorities. Frustration with outcomes is understandable, but undermining judicial independence is the wrong fix.
