@Miirilaw I have a problem with the rule that permits transfers of suits filed in a court without jurisdiction to one without justification. How can you send nothing to another court? I think the rule is bogus and should be challenged.

🚨BREAKING LEGAL ALERT: No more civil jail for debtors at the Small Claims Court. The High Court has declared rule 25 of the Small Claims Court unconstitutional terming it as ultra vires (it went beyond its powers). Rule 25 sneaked civil jail as a mode of enforcing judgements by referencing the Civil Procedure Act. The Court ruled that you cannot create new laws (eg civil jail) just by referencing another Act in the Rules. The Chief Justice’s power to make rules was also held not extend to expanding the penal scope. The modes of executing a judgement before the Small Claims Court will now only include the other modes of execution such as Property & salary attachment. This is the same decision that has held that the Small Claims court does not have jurisdiction over road traffic accident cases.
