Afrophobia has no place in a just and democratic South Africa. Today, we stand in solidarity with migrants, refugees, and foreign nationals living in South Africa. Open Secrets condemns the country-wide protests that have threatened lives and livelihoods, particularly of African migrants. Make no mistake: the growing Afrophobic violence and hate speech targets vulnerable migrants, exploits the economic insecurity of South Africans, and protects those responsible for deepening longstanding social and economic injustice. Open Secrets’ intervention argues that South Africa’s international human rights law obligations, and the globalised reality of multinational corporate activity require that South African courts hear cases that implicate the actions of a foreign government. This should occur where (1) there are allegations of grand corruption and (2) the allegations involve a South African public official or corporation. We say no to corporate impunity for human rights’ violations!

MTN is arguing that ruling on the matter brought by EAC would require the Court to evaluate and pass judgment on the actions of a foreign government. The central issue that the Constitutional Court must determine is whether or not a South African court should hear matters that implicate the actions of a foreign government.

Who holds South African corporations accountable for their conduct outside of South Africa? We argue that responsibility shouldn’t disappear at the border. Establishing that precedent would strengthen corporate accountability, promote constitutional rights and signal that South Africa is serious about ensuring its companies cannot evade responsibility by operating through foreign subsidiaries.   On 26 June 2026, Open Secrets applied to be amicus curiae in the Constitutional Court case between MTN and telecommunications company East Asian Consortium (EAC) – a wholly owned subsidiary of Turkcell. @OpenSecretsZA interestingly all these NGO's never condemn foreigners who are here illegally because they have broken the law but against those who want the laws of south africa to be enforced. illegal migration is a big business for corrupt businesses & private individuals for cheap labour.

The Constitution recognises the centrality of the media in protecting constitutional rights. Open Secrets unreservedly supports journalists performing their jobs, which necessarily includes sending rights of reply.
