मुझे यह समझना है कि शाहबानो जजमेंट को जब संसद ने पलट दिया और वह अवैध हो गया तो आज जो सर्वोच्च न्यायालय ने कहा है, वह संसद के कानून से ऊपर होगा या नहीं?
यदि हाँ तो किस तर्क से? क्या राजीव गाँधी द्वारा पारित संशोधन संसद ने बीच में निरस्त किया है या सुप्रीम कोर्ट अपने दिल की बातें कर रहा है?
विधि विशेषज्ञ अवश्य बताएँ कि संसद का संशोधित कानून ऊँचा रहेगा या सुप्रीम कोर्ट का निर्णय?

@PadamkantD I gave the analogy of discharge application on the logic of filing of fresh application of discharge in a pending trial since if filing is the key factor then discharge must be moved under BNSS which would lead to apparently problematic situation. I get your point though.

How can an application be filed under BNSS in a Criminal Appeal of 2023? An appeal that is going to be governed by CrPC can't have interim applications governed by BNSS. There is absolute confusion over this particular aspect i.e. applicability of procedural law.

As per @indiankanoon database, this appears to be the first order in an application filed seeking suspension of sentence under Bharatiya Nagarik Suraksha Sanhita a High Court.

@Shuk_law_ 228 IPC and 250 BNSS both relate to pending trial. SOS, if a fresh application, is an independent proceeding and thus under BNSS. Key word is “pending trial, investigation, appeal, application”. AGAIN MY VIEW.

@PadamkantD Isn't suspension of sentence application part and parcel of the pending appeal? It's not even maintainable unless Appeal has been admitted. If so, 531 must apply. Can we say in a pending trial, charge would be framed u/s 228 CrPC but discharge application would be u/s 250 BNSS?
