Apparently MHCLG taking 2-3 months to prepare and sign grant funding agreements after funding level approved. Meanwhile materials costs going up and eye watering interim costs still being paid. This is scandalous! #BuildingSafetyCrisis #EndOurCladdingScandal

@oli_hackett Clause trying to stop the Applicant from talking to the press/public about the agreement, project etc. But now makes clear leaseholders can do so in their personal capacity.

Cladding victims - new draft of the BSF Grant Funding Agreement dropped today. It’s much more favourable for leaseholders than the previous draft eg no gagging clause, don’t need all funds upfront, balconies potentially covered #BuildingSafetyCrisis #EndOurCladdingScandal

There’s also a clause making clear the MA/freeholder can’t demand service charge from leaseholders for sums which are BSF funded ie they can’t issue bills without knowing BSF outcome. Hopefully stops these bills landing prematurely for some...?

It isn’t published I don’t think - BSF caseworker should provide it. Get lawyers to read it, but there are substantive changes. Balconies are covered if they have to be removed to access the external wall system. Funds must be ready to complete works (not start). Hope that helps!

@LisaR8624 @CarolineJK9260 @mhclg Yes they’ve never published the agreement. Best thing is to ask MA to get copy from your caseworker. I wouldn’t want to advise on the impact of clauses, but I do think it’s more positive than the previous draft.

@LisaR8624 Yes I think so (some changes around demanding SC and liability of the MA for funds) but you’re better asking the MA for a copy/confirmation. We’re an RTM so those things don’t really affect us - we’re liable as Applicant.

So BSF won’t allow money to be spent on cladding until you have collected money for non BSF remediations. This is all going to go pear shaped fast with works stalling when agents can’t collect all the money and builders won’t do works. Well done Jenrick and co.

@SeVictim @IMedneglawyer @meena77531087 @TowerHamletsJL @mhclg Did your block not need pre-tender funding? Our MA can't complete our full application without the pre-tender funds we've been allocated. And they can't draw those funds down until they sign the agreement. So we're at a standstill...

@LucyMPowell It can’t only cover cladding. It needs to cover all defects (particularly where you can’t claim against developer for breach of building regs at time). Our balconies will cost £700,000 and they aren’t in scope of gov funding currently!
