🚨PUBLIC PROTECTOR KHOLEKA GCALEKA'S HUSBAND WAS SENTENCED TO 15 YEARS IMPRISONMENT FOR STEALING R3, 5 MILLION FROM WITS Little is it known that Public Protector Advocate Kholeka Gcaleka was married to this man Lebogang Dikobe. While she was married to him, Lebogang Dikobe stole a total R3, 5 million from WITS University, while he was an employee at the University. The Johannesburg Special Commercial Crimes Court sentenced former University of Witwatersrand (Wits) employee Lebogang Dikobe (38), to 15 years imprisonment for 30 counts of fraud with a combined total value of over a R3million. Dikobe was employed as a bookkeeper in one of the Wits’ libraries from 2008 until 2014 and his duties included a reconciliation of all library accounts and projects, value-added tax (VAT) account entries and claims, organising and scheduling work to ensure the smooth running of the Library Finance Office and filing. He started his fraudulent acts after registering a company in 2010, called Savinet Information Communication and Technology on the WITS procurement database without declaring he was a Wits employee. He thereafter submitted fraudulent invoices to claim compensation for services that Savinet never rendered. He further faked the signatures of the personnel that approves payments of suppliers. Dikobe continued with his fraudulent activities until 2014 when one of the procurement officers ran into an invoice paid to Savinet that confused her because Wits dealt with the service provider Sabinet, not Savinet. WITS conducted investigations which led to the resignation of Dikobe. The fact that her husband stole R3, 4 million from a government University institution while they were married means Kholeka Gcaleka was enjoying the proceeds of crime, & also raises questions as to how can she now be trusted to investigate crime while she turned a blind eye to crime in her own home. She only left him once he had been arrested. If that's not enough, she's now engaged to the Parliamentary Secretary who hiked his salary from under R2 million to over R4 million, meaning her lobola was paid for by money stolen from our tax. She's had to officially recuse herself from the Public Protector investigation into this salary hike. Advocate Kholeka Gcaleka is limping from one scandal to the next. By:#BaasKruger

An interim interdict is a stop gap measure seeking to stay the impeachment process pending the outcome of the review. In practice, it’s done in two parts being Part A (the interdictory relief) & Part B - the review. Not a foregone conclusion that the interdict will be granted.

@MbekezeliMB Yes and ‘interim’ means a delay in the interim. Otherwise why bring the interdict? The point stands that the goal is now not merely to review the report, but to halt Parliament in the meantime.

An interim interdict delays something temporarily. That delay is itself is material, when public power is exercised. That’s why OUTA says interim interdicts shouldn’t be easily granted in contexts like these. In the Mkhwebane case, WC High Court applied OUTA to impeachment proceedings and refused the interim interdict to avoid any delay.

Ramaphosa can not interdict the impeachment process . President Cyril Ramaphosa's legal review of the Section 89 Independent Panel Report does not automatically stop Parliament's constitutional obligation to conduct an impeachment inquiry. To halt the committee, he must explicitly secure an active court interdict, as political discomfort or a review application alone cannot suspend the process. The Legal Framework The Constitutional Court Ruling: Chief Justice Mandisa Maya ruled that the Section 89 inquiry must be implemented by referring the matter to an Impeachment Committee "unless and until the report is set aside on review". Review vs. Interdict: Legal experts clarify that filing for a judicial review is not an automatic freeze. Parliament can legally proceed with forming and running its 31-member committee unless Ramaphosa successfully files and wins an urgent court interdict to pause them. Separation of Powers: The courts are highly reluctant to interfere with the internal procedures of another branch of government. Because holding the executive accountable is a core constitutional mandate of the National Assembly, courts may rule that an interdict inappropriately interferes with Parliament's right to perform its oversight duties. What Happens Next?Committee Work: National Assembly Speaker Thoko Didiza announced the committee, and Parliament is proceeding with gathering nominations to process the report, despite the President challenging the factual conclusions and legal reasoning of the panel. I’m not defending Ramaphosa in any way, but Sizwe seems to have a very personal agenda driving his obsession with Ramaphosa. It doesn’t come across as a genuine effort to hold him accountable, combat corruption in South Africa, or uphold the rule of law.

A review is one thing. But delaying Parliament from implementing a Concourt order presents entirely new legal obstacles for the president. It also makes the presidency look increasingly desperate to avoid accountability on Phala Phala.
