I keep seeing this argument that Trump has no authority to mandate a private organization like the NCAA via executive order or action. That's true. But that's also not what he's done. He hasn't signed an executive order mandating what the NCAA has to do. It's a lot more subtle and clever than that. Congress appropriates funds, and the executive branch then spends the money accordingly, but is able to exercise significant discretion. The order has said things the NCAA "should" do, and hasn't mandated what it has to do. Instead the order seeks to work by creating leverage over the universities themselves by directing federal agencies to create requirements or measures, ie, conditions, the universities have to comply with in order to receive certain federal funding. It's definitely not obviously unlawful on its face. The Supreme Court has ruled that the executive branch can sometimes add conditions to receiving federal funds (which administrations have been doing for a long time). At most, it's gray and unclear whether he's done anything unlawful. It's certainly not an easy black and white decision.

PROP 4 REPEAL UPDATE: Another notable knock off of signatures in the Cottonwood Heights Senate District 15 from yesterday. There are now only 115 signatures left to remove in that district before the ballot measure wouldn't qualify. At this pace, that could happen by week's end. Opponents of @RepealProp4 removed 118 signatures since yesterday. @abc4utah #utpol

And this right here, what just happened in Indiana, is why making an example of the Jazz was a short-sighted decision/slippery slope. 1) Zubac returns to action from extended time off, plays heavy 1H minutes. Looks good scoring 8 PTS (4-6 FG). 2) Nembhard drops 23 PTS (!) in the 1H in just 17 mins. They both disappear at halftime, and dont play a single 2H second in what was a respectably close game for a majority of it. Pacers (a team with losing incentive) lose. Sound familiar? The franchise comms team will likely issue an injury management explanation to avoid the eye of Secaucus Sauron/refute the imminent tanking allegations. Is it possible both players got sore in the locker room/hurt in the first half? Sure, I guess. The point here is that by fining the Jazz for conduct detrimental to the league, NOT (⬅️) a Player Participation Policy violation, your games are now going to be under the microscope in the event this type of starter rotation activity occurs again. You can’t just fine one franchise and hang their reputation from a tree to scare the other citizens from replicating the same behavior. That selective enforcement is what put you in the spotlight originally, because Jaren Jackson Jr./Lauri Markkanen ended up either getting surgery or having a legitimate hip injury keeping them out for the foreseeable future. Nembhard/Zubac may end up experiencing something similar to JJJ/Markkanen, they may not, but the inconsistent enforcement WITHOUT knowing their personal medical records is reflective of a business that only steps in when the seat gets hot. The Jazz ended up winning some of those games they were so highly scrutinized for. The Pacers lost tonight. This alone does not justify penalizing the Pacers, because Micah Potter was trying to win just as much as Brice Sensabaugh was for Utah. Players dont tank. If you’re not going to fine the Pacers for this tonight, then just give the Jazz governors their $500,000 back, because this hypocrisy is what’s damaging the league reputation more than the integrity of the game.

@nihilists4jesus The state of Utah also has a law that requires land in its trust to be used in the most profitable way possible. Much of this land will be sold off to the highest bidder. It’s hard to manage for conservation when the law says this.

Fore non-essential issues, we can disagree better. But for big ones there is no compromise. During the War In Heaven, or during Captain Moroni's battles, there was no way to "disagree better." The friction is about fundamental facts: 1) Gender is an essential characteristic of individual premortal, mortal, and eternal identity and purpose. 2) Marriage between man and woman is essential to His eternal plan. 3) Charlie Kirk's murder 4) Somali Daycare Fraud 5) "The first duty of the American government is to protect American citizens. Not illegal aliens." There is no way to "disagree better" about these three.

@tvheidihatch BYU put themselves between a rock and a hard place. If the police knew but failed to share information that is a Clery act violation. It’s what Utah was accused of in the lead up to the Lauren Mccluskey murder and was a contributing factor in the 13.5 million dollar settlement
