@angell_phoenix @ABC No one is overstaying their visa. AOS can’t be approved if they’re here unlawfully. Part of AOS is showing you’re maintaining status. Also, Congress created H-1b and L visas specifically to allow the intent to immigrate. This policy has no benefit to the US.

@ABC People don’t understand what a temporary visa is. That is for tourism, education, business, etc. not immigration and has a time limit for how long they can stay. Tired of the knee jerk reactions just because Trumps name is in a headline.

@marcellstrbich @EricLDaugh Yes this applies to R visa holders if they’ve applied for green cards. It doesn’t apply to dual intent visas. Don’t panic, this may just be a mountain out of a molehill.

It's not a loophole when the majority of immigrant applicants get their green card that way. In fact, that's been the case for 65+ years.

This claim is a LIE. Congress created adjustment of status in 1960. It's not a loophole. In fact, @USCIS's OWN WEBSITE says that getting a green card from inside the United States was expressly intended by Congress! Just wait; give it 24 hours and they'll erase that history.

@USTechWorkers J is a non-dual intent visa too. They can only transfer to H after getting a waiver and there are only 30 per state annually. Most of those waivers focus on primary care. Look, it will impact medical training and patient care. Hard to know how much but it will.

@Tomales18 A. F-1 is a non-dual-intent visa, and it’s good that this loophole of self-petitioning for a NIW while on OPT is being closed. B. Most FMGs arrive on J-1 visas and then transition to an H-1B. It’s a very unusual and uncommon route to use OPT to enter residency.

There are a lot of bad takes circulating about what this USCIS memo actually means. It’s not targeting scientists or doctors pursuing employment-based green cards through the normal legal process. It’s mostly aimed at aliens who enter on tourist visas, conceal immigration intent, abuse loopholes, or use deceitful tactics to game the system while seeking adjustment of status.
