Dans ce type de dossier, le droit compte, mais le contrôle réel se joue surtout sur le terrain, à travers les alliances politiques, industrielles et financières. 1. Poursuivre la bataille juridique : une stratégie de pression AVZ peut continuer l’arbitrage jusqu’au jugement final. Objectifs : - obtenir des dommages financiers significatifs, - maintenir une pression sur la République démocratique du Congo, - dissuader l’entrée de nouveaux investisseurs sans accord préalable. Limite : gagner juridiquement ne garantit pas de récupérer le projet. 2. Négocier un accord stratégique Option plus pragmatique : s’inscrire dans une recomposition du projet. AVZ pourrait : - accepter une dilution de sa participation, - intégrer un consortium avec un acteur majeur comme CATL ou un partenaire soutenu par un État, - monétiser une partie de ses droits. Mieux vaut une part réduite dans un projet actif que 100 % d’un projet bloqué. 3. Transformer le conflit en sortie financière AVZ peut aussi viser un “exit stratégique” : - indemnisation substantielle, - règlement à l’amiable, - cession de ses intérêts. Une issue fréquente dans les arbitrages internationaux. 4. Activer le levier politique et médiatique Enfin, l’entreprise peut jouer la carte de l’influence sur la communication avec une bonne équipe : - mobiliser les investisseurs internationaux et l'opinion locale. - alerter sur le risque pays en RDC, - s’appuyer sur des relais diplomatiques. Objectif : rendre son éviction totale politiquement coûteuse. AVZ fait face à un choix stratégique central : maximiser le contrôle… ou maximiser la valeur. La voie la plus réaliste reste un équilibre : maintenir la pression juridique au CIRDI, tout en négociant en coulisses un accord ou une sortie valorisée. Obviously you feel differently as you most likely have a vested interest in kobolds gain at the expense of $AVZ shareholders.

$AVZ #DRC: A critical setback for @AvzMinerals in its dispute with the @SuminwaJudith Government at the ICSID. The ICSID no longer requires the DRC to reinstate AVZ's permit. And while the ICSID has no authority over resource permitting in any sovereign nation (including DRC), this ruling effectively means Kinshasa can do what it wants with disputed permits (which it already has been doing). It also strengthens KoBold's hand as the primary investor the DRC gov't has contracted via a July 2025 MOU to resolve the dispute with @AvzMinerals. That said, I need to stress this is NOT a total setback for AVZ as the ICSID has not yet ruled on the merits of this case - namely, that DRC broke its own laws by revoking Dathcom SA exploration permit for the lithium and tin fields in/near the town of Manono, DRC. But it is a major one that @AvzMinerals management was clearly not prepared for. To state this clearly, @realDonaldTrump fully and completely trusts @Presidence_RDC and does not care about corruption or repression in Congo - mostly because Trump is himself corrupt and wants to be a dictator. I repeat for clarity: Trump does not care about corruption or repression in Congo under Fatshi and fully supports his regime. He only cares that Congo makes its resources available to America to make it great again. You must understand and accept this reality. The only path forward to resolving the $AVZ dispute is what the Trump Admin literally told the CEO of @AvzMinerals in a recent meeting: you must sell to American investors and drop all claims in Manono. I once again urge AVZ retail holders to accept these realities and accept the only offer that is on offer from the Americans.....before it is too late.

To be clear, KoBold has plenty of money and it's offers to AVZ at this point have been what they are legally required to be under Australian law - "fair value" (not "commercial terms"). I would remind my AVZ friends on X that Nigel & Co must consider and disclose any such offer by KoBold per Australian securities law and failure to do so OR to turn down an offer of "fair value" could expose it to either more lawsuits by the authorities or it's current shareholders.

KoBold Metals could face courtroom drama or prolonged legal headaches similar to AVZ Minerals' saga—if the underlying governance and corruption issues in Kinshasa aren't fully addressed. @OutdoorFinance Everyone will tell you that you should be happy with a loving wife and kids, although an important piece to the puzzle men are happiest when they are creating something,building something which provides purpose often referred to doing something you love, 9-5s destroy creativity.

I feel like I have lost my “spark.” I’m 31, I have a good paying job. It’s pretty stressful but I worked so hard for my degree to get here. All life seems to be is work and get a few hours at home with the wife and kid just to wake up and be gone all day again. It’s really difficult to get out of a mental rut like this. My soul craves adventure and more time with my wife and daughter.
