@Abramjee This judgement will not assist those that are caught with hand held speed trap cameras as the offence would have been committed in the presence of an officer and arrest will be justified under s40(1)(a) of the CPA. On the facts that were before court, the judgement is correct.

A recent judgment of the Western Cape High Court has provided important clarification on the lawfulness of arrests and detention for speeding offences. In Zilwa v MEC for the Department of Transport and Public Works and Another (2026), the Court held that the arrest and detention of a motorist for speeding alone was unlawful, notwithstanding that the alleged speed was significantly in excess of the posted limit.  The Court described such an arrest as a drastic and unjustified intrusion on personal liberty, inconsistent with South African criminal procedure and constitutional standards.
