Atteridgeville, Pretoria: Armed suspects stormed a house and robbed the occupants of phones, cash, and a vehicle belonging to the homeowner. The victim’s son-in-law, who was on a call with his wife when it suddenly cut off, heard the disturbance and rushed to the house. On arrival, he found 3/4 suspects attempting to flee in the stolen vehicle. When he approached, they allegedly opened fire and shot him in the stomach. He returned fire, fatally shooting two suspects, wounding another, while one managed to escape. WARNING: ⚠️ Graphic.

A recent judgment of the Western Cape High Court has provided important clarification on the lawfulness of arrests and detention for speeding offences. In Zilwa v MEC for the Department of Transport and Public Works and Another (2026), the Court held that the arrest and detention of a motorist for speeding alone was unlawful, notwithstanding that the alleged speed was significantly in excess of the posted limit.  The Court described such an arrest as a drastic and unjustified intrusion on personal liberty, inconsistent with South African criminal procedure and constitutional standards. @MhlongoPower @MontjaneK @Abramjee The speed was captured by the fixed ANPR average speed cameras which sent a report hours later that the car exceeded the speed limit by more than 40 km/h. Under these circumstances the appropriate thing is to issue a notice to appear in court.

@TrevorMal @Abramjee No it does not change the schedule of the offence but if the crime happens in the presence of the officer then he does not have to rely on s40(1)(b) to justify the arrest without a warrant. In this judgement the crime was captured by the ANPR speed cameras hence the difference.

JUST IN: Reports emanating from French media suggest that South Africa's ambassador to France, Nkosinathi Emmanuel "Nathi" Mthethwa, has been found dead in Paris - just a day after he was reported missing. According to the reports, the 58-year-old diplomat’s body was discovered outside the Hyatt Regency Paris Étoile in the Porte Maillot district. It is alleged that he fell from the 22nd floor of the hotel, though French authorities have not yet confirmed the exact circumstances surrounding his death.
