As recently as the 1970s, the crime of rape was defined as: (1) sex (2) with an unwilling woman (3) achieved through force (4) overwhelming her resistance. This is a serious violent crime. A person who does this should be imprisoned for years if you’re a liberal and hanged in the town square if you’re sane. It’s also a crime whose elements are easily established beyond a reasonable doubt through evidence. But then, we completely redefined what “rape” is. The first objections to the traditional definition were fairly reasonable: Why is the victim’s resistance an element of the crime? No other violent crime requires a victim to resist. Robbery is just (1) theft (2) by force or threat of force. Why do we require rape victims, but not robbery victims to fight back against their assailants in order to satisfy the elements of the offense? So, the resistance element was eliminated. Then the question of what level of force was necessary, and courts and legislatures determined that that any mechanism by which sex with an unwilling person was achieved constitutes a sufficient amount of force. So, we are left with the contemporary definition of rape, which is (1) sex (2) without consent. This, unlike the old definition of the crime, is an offense that does not necessarily involve overt and unambiguous violence. Consent is nebulous and hard to define. People have different subjective definitions of it. Is acquiescence consent? Is verbal consent insufficient if it is unenthusiastic? Its existence or absence is incredibly hard to establish to a third party after the fact when the people involved disagree about what happened. This means it is hard to prove rape beyond reasonable doubt in a trial, because the entire case is just two people with diverging narratives of the same event. Prosecutors are hesitant to bring charges in these cases because in the absence of clear evidence of violence, it is difficult to convince juries to find guilt. Unlike the violent offense of forcible rape, “sex without consent” often happens between people who know each other in dating contexts. Even though “sex without consent” often carries the same legal penalties that “sex with an unwilling woman achieved by force overwhelming her resistance” carries, many women who consider themselves victims don’t perceive these rapes to be matters that should involve police or prisons, creating a huge degree of cognitive dissonance. So, there’s now a huge amount of “rape” is nominally a serious violent crime, but is so vaguely defined and subjective that many people — including self-identified victims of it who call it rape — don’t think of it as something that should be dealt with through the criminal justice system. So it is often instead punished through parallel processes with lower standards like university administrative tribunals or online reputational destruction or pressure on employers to fire people. These settings lack both the procedural protections and evidentiary standards to protect the innocent from false accusations and the punitive capacity to incapacitate dangerous sex offenders and keep them from preying on new victims. By changing the definition of rape to include lots of complicated situations that were clearly outside the scope of the offense a few decades ago, we have made sexual violence more difficult to prosecute in the criminal justice system and we have made messy hookups much easier to prosecute in the media and in star-chamber administrative tribunals. It is far from clear that these changes have made women safer or better off. Additionally, this has made it very difficult to determine how much sexual violence is actually occurring. When surveyed, a high percentage of women will identify as victims, but incidents are reported to law enforcement at a much lower rate, and result in criminal convictions even less often.
