Justice Swarana Kanta Sharma’s rejection of Arvind Kejriwal’s recusal application today is a masterclass in judicial backbone. By refusing to let a politician "judge judicial competence," she has single-handedly halted a dangerous attempt to turn the Delhi High Court into a "theatre of perception". Justice Sharma decimated the legal basis of the application using established precedents. Let us have a look: The "Presumption of Impartiality": She reiterated that impartiality is a presumption in favour of a judge, not a "manufactured test" litigants can manipulate. Threshold of apprehension: Citing the standard of a "fair-minded and informed observer," she ruled that Kejriwal’s claims, such as her children's legal careers or her attendance at Adhivakta Parishad events, did not pass the threshold for "reasonable apprehension of bias". Precedent against forum shopping: The ruling leaned into the principle that litigants cannot "choose their judge" (Chetak Construction Ltd. v. Om Prakash), branding the move as strategic forum shopping disguised as a plea for fairness. The "Duty to Sit": Relying on the doctrine that a judge must hear cases assigned unless there are objectively justifiable grounds, she called the easy path of recusal an "abdication of duty" and an "act of surrender". In short, this is Kejriwal's PR stunt gone wrong. Kejriwal’s team tried to build a Catch-22 situation: if she recused, they’d claim victory over "bias", and, if she stayed, they’d cry "persecution" on social media. Justice Sharma saw right through it, noting that the applicant had created a "win-win narrative" for himself regardless of the law. The hypocrisy is glaring. This is the same AAP that celebrates the judiciary when it grants interim bails but launches "vilification without accountability" the moment a judge asks tough questions about 40,000 pages of evidence. By flagging the "seeds of distrust" planted by the politician, the court essentially told the Kejriwal gang that their digital narratives have no jurisdiction over the bench. Today, the robe stood firm. Justice Sharma’s message to the political class was loud and clear: Judicial integrity cannot be put to trial by a litigant. In a world of "managed justice," this was a rare, raw victory for the independence of the Indian judiciary. Institutional respect won. Perception-led bullying lost. India's current opposition needs to know that their political battles belong in the streets and at the ballot box, not in the crosshairs of a judge’s personal and professional life.

Last week, my colleague @debanganaghosh4 travelled to Nashik to report on the crisis at TCS. In under 48 hours, she accessed all 9 FIRs and spoke to the SIT head, public prosecutor, and defence lawyers. Her @moneycontrolcom story, published today, raises tough questions. TCS said it didn’t receive complaints via POSH (prevention of sexual harassment) channels. Per the FIRs, Ashwini Chainani, a delivery operations head who’s been with the company for over 20 years, dissuaded young women from filing complaints, even as she was part of the POSH committee. When there was a complaint about Shafi Shaikh’s conduct by a woman employee in 2022, senior manager Nitin Kapoor merely shifted him to another department. Kapoor also wrote several mails to Chainani about the lack of work ethic among the accused (tardiness, bullying, subpar work), but even those were seemingly ignored. Many of the complainants are young employees from economically vulnerable backgrounds who, according to investigators, were hesitant to come forward earlier. Another key gap: the identity and role of the Nashik unit’s HR leadership remain unclear. According to the FIRs accessed, a common pattern of alleged harassment involved repeatedly asking women intrusive questions about their private lives, despite them not wanting to answer. This included questions on whether they had physical relationships with their boyfriends, whether they were going on a honeymoon with their spouse, commenting on a woman with Polycystic Ovarian Disease (PCOD), and telling one of the complainants to work on her body and lose weight. Public prosecutor Kiran Bendbhar, who is representing eight out of the nine complainants, told Moneycontrol that Ashwini Chainani was also, in fact, a part of the company’s Prevention of Sexual Harassment (POSH) committee, yet she failed to raise the complaints. SIT’s Mitke said the victims were scared because none of the managers they had been verbally raising complaints with took any action. Total committed investment across all four: over ₹1.5 lakh crore. In 2020, if you said "India will manufacture semiconductors," people laughed. The standard line was "India missed the bus 30 years ago." Taiwan took 40 years to build TSMC. South Korea took 25 years for Samsung foundry. India is trying to do it in under 5. I think the skeptics are confusing "difficult" with "impossible." Tata built Asia's first steel plant when the British said Indians couldn't smelt iron. That was 1912. Same energy.
