The proposed Act amendment to reintroduce property tax with retrospective effect from 1st April 2010 is deeply concerning and legally untenable, as it directly contradicts the clear rulings of the Hon’ble Bombay High Court and Hon’ble Supreme Court, which had struck down key provisions and disallowed retrospective applicability. The amendment further seeks to empower the @mybmc Municipal Commissioner to prescribe rules, formulas and methods for fixing capital value with both prospective and retrospective effect, raises serious concerns of excessive discreation without adequate safeguards. Citizens of Mumbai had complied in good faith with the court’s interim orders and paid property taxes accordingly, any attempt now to recover additional or balance dues along with penalties and interest would be grossly unfair and impose an unjust financial burden on lakhs of taxpayers. Such retrospective taxation not only undermines judicial authority but also creates uncertainty, erodes public trust and penalises honest citizens for no fault of theirs.
