OK, a lot of, "but Garland" in my replies. I was a senior Senate staffer at that time and opposed moving on Garland. I argued that we should be clear that we weren't moving on him on the merits and not make a fake argument that precedent controlled. I still think I was right on that.

@greggnunziata You did destroy the court with Garland and then ACB. You don’t see it that way, but to half the country that is exactly what happened. The court has been stripped of its legitimacy. Adding four justices is the same hardball that Rs have already played with scotus.

Think about what Roe meant to conservatives. The Court legalized abortion on demand. Invalidating state laws. Without law, based on penumbras. Enabling the slaughter of millions of innocents. A massive illegal power grab to do great harm. We worked to change, not destroy, the Court.

@greggnunziata And a new opening every 2 years would mean each confirmation fight isn’t an existential crisis. It would also make the court more responsive to major long term shifts in public sentiment — which is not a bad thing for our system of government.

@greggnunziata You don’t think 18-year terms with a new seat opening up every 2 years makes more sense? The fate of the court shouldn’t hinge on someone’s health, and nobody should serve 30, 40, 50 years. Serving for life didn’t equal such a long tenure when the Constitution was written.

They serve for life, but the number of justices is not set. Changing the number of justices would be legal and constitutional, but if done to punish the Court and change its rulings, deeply corrosive to the constitutional order.

@Kaisa25Gaming @thorsson_john @greggnunziata What personal ambition? Where is there to go after the court? If they want to run for president or whatever they are welcome to do so now. They can always quit the court. That wasn’t unheard of in the 19th century.

@greggnunziata Between Garland and ACB, that’s two instances where a norm was shredded. Two scotus seats stolen as far as Dems are concerned. So you’re right this is now a partisan rock fight. Dems will add seats to the court if they get the chance, and they’re justified in doing so.

@greggnunziata You were opposed to moving him on the merits? You don’t think he was qualified? This whole “they’d have done it too” line is exhausting. Garland deserved a hearing and a vote. And you haven’t addressed ACB being rammed through when folks were already casting ballots.

@greggnunziata That ship sailed when McConnell blocked Garland for a year and then jammed ACB onto the court when voters were in the middle of voting Trump out of office. 18-year terms make sense. Justices live longer now. A new one every 2 years will make confirmations less contentious.

Is was long properly understood in America that Court packing amounts to a knife to the heart of of the Constitutional order and the rule of law. If the next Democratic White House does this, it will accelerate, not reverse, the damage Trump has done to our democracy.

We've now passed half a dozen national polls w/Trump's approval among Whites w/out a four year college degree falling to about 50-50. He won 2/3 of those voters in each of his three races . They're still mostly skeptical of Ds but Trump has given Dems their best opening in years
