I may be missing something, as this doesn’t strike me as complicated. If the means are known to be anticompetitive, then they are per se illegal regardless of outcomes (eg even if fixing wages happens to coincide this one time with higher output, it’s still illegal). 1/

@TedTatos @Sherman1890 @lawprofblawg Antitrust is not concerned with only price and output, but focusing on them has almost nothing to do with overlooking monopsony power. Like seller market power, monopsony power can harm trading partners because of its effects on (reducing) price and output.

@Sherman1890 @lawprofblawg Thinking antitrust only concerns itself with price & output reflects the myopia that rendered mainstream IO oblivious to monopsony power for so many years. Alston, In Re High Tech, etc. were antitrust cases concerned with the exercise of market power on the input side.

Herb Hovenkamp (@Sherman1890) spent most of his career at Iowa Law, an excellent but non-elite law school. He could have gone anywhere. He devoted countless hours to stewarding one of the most respected and influential treatises in all of law. He could command huge bucks for his influence, but he does not do so. I’ve often disagreed with Herb, but he has been unfailingly generous despite our disagreements. He is kind to people who revile him on this platform. The idea that he is “bought” is beyond ludicrous.
