By arrogating immense power to himself through control of Senate procedure and schedule, the Leader is able to fundraise on a massive scale from organizations with business before the Senate— corporations, unions, trade associations, other lobby groups. He then uses his control of those funds to shape and direct member behavior. He also has a strong incentive to back incumbents in order to conserve funds by avoiding costly open races with competitive primaries. The notion that individual Senators could shape the lawmaking process is a direct affront to this entire structure of the Senate that has emerged over the last 20 years, which Harry Reid first pioneered and McConnell continued and refined. The ‘zombie filibuster’ is a way of ensuring legislative maneuvers are orchestrated and negotiated by leadership. It protects the power and fundraising ability of the leader by keeping individual Senators in their place, like back-bench House members: stick with the caucus, don’t get too independent-minded, and you won’t have to worry about money for your reelection. The simplest way to reform the current Senate system would be to repeal the 17th amendment and return Senate elections to the State Legislatures. But good luck getting 67 Senators to agree to that.
