The Federal Court (Moshinsky J) in Lesbian Action Group Inc v Australian Human Rights Commission [2026] FCA 432 allowed the appeal. Lesbian Action Group sought a 5-year exemption under s44 of the Sex Discrimination Act 1984 (Cth) to hold events for "lesbians born female" only, arguing it was needed for their rights of association and expression. The Australian Human Rights Commission refused; the Tribunal affirmed. Court found the Tribunal erred by: (1) too narrowly construing s44 (exemptions can permit justified discrimination if balanced against SDA objects); (2) failing to apply the mandatory human rights regard duty under s10A of the AHRC Act. Verdict: Tribunal decision set aside. Case remitted for fresh determination by a differently constituted Tribunal.
