In common use, ‘discrimination’ refers only to the unjustified, unethical or illegal, forms of discrimination. But international human rights frameworks include provisions for when we can justify what is otherwise discriminatory. There’s a four-fold test. First, the policy must be in service of a worthy social goal. We have prisons and override the right to freedom of movement, partly on the grounds that doing so is in service of the worthy social goal of ‘promoting public safety.’ We can argue about whether this is effective, but the first test is merely to ensure that policies are in service of a worthy social goal. Second, the policy must be necessary for the promotion of the worthy social goal. If we can achieve the worthy social goal without infringing upon human rights, then we must. We can only potentially be justified in overriding human rights if doing so is necessary for promoting a worthy social goal. Arguably, the death penalty is not necessary for promoting public safety, and thus arguably fails this second test. Third, the policy must be effective at promoting the worthy social goal. Even if a discriminatory policy might be judged necessary for promoting a worthy social goal, if it isn’t effective at doing so, then it fails to be justified. Aprimary justification for the death penalty is to deter other crime. Arguably, evidence suggests that the death penalty is not effective at such deterrence. And since there are other methods capable of preventing someone from reoffending, the death penalty is neither necessary nor effective, and so is not justified. Finally, the benefit from promoting the worthy social goal must be proportional to the harm caused to the group or individuals discriminated against by the policy. Generally, policies that discriminate against already vulnerable or stigmatised social groups, even if they are necessary and effective in service of a worthy social goal, will fail to be sufficiently proportional. Appeal to the small size of a group will not suffice, either: the proportionality test is not a utilitarian calculus whereby a large group can benefit greatly at the expense of a few. What’s most crucial about human rights is that the default position is inclusion. The default is not “Exclude trans women until we have more evidence about there not being an advantage or a threat. Rather, the default must be “Include trans women unless we have sufficient evidence to justify discrimination in an international human rights framework. This is why the human rights framework controls this “debate.” Trans women don’t have to justify our inclusion even in sports. The burden of argument is entirely on those who seek to exclude us. And, , that burden has not yet been met in a single female space including female sports, and is unlikely ever to be met. Trans-exclusionary policies fail on every measure. And finally, trans women are a heavily stigmatized and marginalized group, particularly trans women of color, and particularly trans women of color from the global south. And since the benefits to society of discriminatory policies that further harm an already marginalised, stigmatized group tend not to be proportional, excluding trans women also fails the proportionality test. NEW: FedEx driver who is accused of abducting and strangling a seven-year-old girl, puts his face in his hand as a photo is displayed of him driving her to her death. 7-year-old Athena Strand was seen standing behind Tanner Horner in his FedEx truck. Athena was allegedly snatched by Horner when he was delivering a Barbie doll to her home in Paradise, Texas. Horner initially claimed that he accidentally hit the girl with the truck before "panicking" and pulling her into the vehicle. He said he then strangled her in the vehicle and dumped the body 7 miles from the home. The photo, however, shows that Athena was alert in the truck and did not appear to have been struck by the truck. Wise County District Attorney James Stainton says the jury will see footage on the day of the killing, depicting the moment Athena was strangled to death. "Somebody covered up the camera because they don't want you to see. Guess what? Audio is still running, and you're going to hear it. You're going to hear what a 250-pound man can do to a 67-pound child," he said. "And when I say it's horrible, I mean it. I've been doing this for 25 years, and I promise you, buckle up." Horner qualifies for the death penalty.

TransLucent Resignation Statement: Seeking to take the Labour Party to court. Some 6+ years ago, I started a personal blog, which led to a group of campaigners, which in turn led to an organisation we now know as TransLucent. It’s been an amazing journey for me as a founder and CEO. Still, in life, things change, and chapters end. In December 2025, the Labour Party discriminated against me by barring me from a space where I was once welcome - the National Women’s Conference. The Party claims that this is due to the Supreme Court judgment (FWS v SGM). I believe the Labour Party has been badly misinformed by their lawyers and could have chosen to remain trans inclusive. A court, perhaps ultimately in Strasbourg, will need to decide. I know this may be a marathon journey, but it is inconceivable that when the Gender Recognition Act was drafted, exemptions, which included single-sex spaces and female sport, would also mean a trans woman could not attend a conference. For nearly a year, the Labour government has witnessed the chaos the Supreme Court judgment has caused: likely suicides, certainly suicide attempts, trans people outed at work, trans women and girls expelled from Girlguiding, and volunteers quitting in protest. The Women’s Institute has excluded trans women who had been members for decades, resulting in multiple branches closing, leaving many elderly s!s women without the companionship they cherished. This is madness, and the Labour government could and should have intervened - neither Girlguiding nor the WI wanted to exclude - this gender-critical “lawfare” has to be stopped. I never imagined that I would be the one embarking on this epic journey to help overturn the FWS judgment, and I know the right-wing media will target me relentlessly with lies and misinformation - something I have faced several times before. As I begin my legal case, it is clear that I can no longer remain the public face of TransLucent, which is not involved in my personal dispute. I have served the Labour Party loyally in various Women’s positions in the past. As a post op trans woman with a Gender Recognition Certificate and as an award-winning feminist, I am truly disgusted, but while I feel desperately let down, it is my intention to remain an active member of my CLP. I am pleased to confirm that Prof. Stephen Whittle OBE (who co-founded Press for Change) and Dr Debora Diamond, both eminently qualified, will take my place at TransLucent. I know they will do a superb job. My immediate resignation will not affect the tireless advocacy work the organisation has undertaken -TransLucent will continue to fight for the dignity, respect, human rights and healthcare that trans people so richly deserve. I have had months to prepare for this, as my dispute with the Labour Party has been ongoing since December. Although I am leaving my position at TransLucent, I will continue being involved in the cause of human rights and intersectional feminism. @iwontwheesht @tribunaltweets I don’t think so, I believe NC’s comments rightly pointed out that the law is the law, so ignorance or mis interpretation doesn’t defend you from breaking it. For me from the summation it’s ‘intent by default’ of either inaction, incorrect policies or siding with a belief.
