Kripto varlıkların vergilendirilmesi ile ilgili sosyal medyada dolaşan kanun teklifi ilk halidir.
İktidar kanun teklifinin ilgili maddelerini geri çekmiştir ve bu maddeler TBMM'de görüşülmemiştir.
Plan ve bütçe komisyon üyeleri olarak bize iletilmiş yeni bir tasarı yoktur.

Quantum? Nothing burger.
First: These big corporations will not hand their quantum computers to theoretical researchers to break blockchains.
Second: Breaking blockchains to steal money is still = stealing money = against the law.
Third: By the time people with the intention to rob blockchains using quantum tech get their hands on it, devs would’ve patched resistance into them.

Kripto Varlıklara yönelik vergilendirme düzenlemesinde; Mining, Airdrop, DeFi, SocialFi, GameFi ve benzeri kapsamlarda vatandaşın elde ettiği kripto varlıklara dair büyük bir soru işareti var.
Mining ile elde edilmiş 50 BTC'nin 15 yıldır bir soğuk cüzdanda beklediğini varsayalım. Vatandaş bunu beyan ettiğinde %40'a varan gelir vergisi ödeyecek. Diğer yandan yerli borsaya TL atıp Zobidik Meme Coin alıp 1000x yapan vatandaş alım, satım ve transferler için 10 binde 3 vergi ödeyip hesabı kapatacak.
Verdiğim örnekte uç noktalara değindiğimin farkındayım, anlaşılması için özellikle abarttım ama kripto varlıkları sadece kripto para olarak görmeyen, farklı ekosistemlerde bunlar ile işlem yapan çok insan var.
Yurt içinde işlem yapana çok düşük kripto işlem vergisi, yurt dışında yüksek risk alıp fırsat kovalayıp kazandığını getirene yüksek gelir vergisi maalesef adaletsiz bir yaklaşım. Blockchain tabanlı farklı modellerde tüm bu kazanımlar gelir vergisi kapsamına alınırsa bu sermaye alternatif rejimlere kaçar.
Ayrıca bu yaklaşım 13 Mart 2025 tarihli Resmî Gazete'de yayımlanan "Kripto Varlık Hizmet Sağlayıcıların Çalışma Usul Ve Esasları İle Sermaye Yeterliliği Hakkında Tebliğ" 24. maddesindeki "...platform müşterilerine ait kripto varlıkların müşterilerin kendi cüzdanlarında bulundurulması esastır" ifadesi ile de kafa karışıklığına yol açıyor. Saklama için vatandaşın varlıkları kendi cüdanında tutması esas kabul edilmiş ama bu cüzdandan borsaya yatırma durumu beyan ile gelir vergisi doğuracak.
Ok yayadan çıkmadıysa, hem ülkedeki kripto ekosistemin gelişmesi hem de vatandaşın adaletli işlem yapabilmesi; için Türkiye'deki borsaya getirilen varlıktan sadece 10 binde üç oranında transfer, satış ve çekim vergisi alınmalı. KYC zaten zorunlu. AML zaten takip ediliyor ve şüpheli işlem/tutar için gerekiyorsa vatandaş getirdiği varlığın kaynağına dair (Airdrop, Mininig, Staking, Yabancı Borsa, vb.) beyanı yine versin. Ondan sonra yurt dışına giden sermayeyi değil, yurt dışı yerleşiklerin Türkiye'de nasıl hesap açacağını ve ülkeye giren sermayeyi konuşalım.
Yok eğer sistem zaten önerdiğim şekilde kurulduysa (metinden öyle anlaşılmıyor) veya ikincil düzenlemeler ile bu sağlanacaksa, şüphe ve soru işaretlerini kaldıracak, bir açıklama yapılmalı.
Kimsenin vergi kaçırmak istediğini düşünmüyorum ama yenilikçi bir takım finansal enstrümanlardan ve bunların oluşturduğu benzersiz ekosistemlerden bahsediyorsak, dünyada sözümüz geçsin arzusundaysak, üstüne bu işten millet ve devlet olarak fayda sağlamak istiyorsak belirsiz noktaların tamamı netleşmeli.
