“Cockroaches.” “Parasites.” An impeachment campaign. A demand for public apology. And now, a full-blown constitutional storm around the Chief Justice of India. In just 48 hours, India’s judicial discourse has exploded after CJI Surya Kant’s controversial courtroom remarks triggered outrage across the legal community, activists, media circles, and social media platforms. Senior Advocate Prashant Bhushan has openly accused the CJI of showing “antipathy towards activists” and demanded a public apology, arguing that such remarks strike at the heart of free speech and constitutional criticism protected under Article 19(1)(a). At the same time, lawyer J Anant Dehadrai has come out strongly in defence of the CJI, saying the remarks were aimed at organized vilification campaigns against judges and were part of a legitimate institutional self-defence against attacks on judicial integrity. What makes this controversy bigger than an ordinary social media outrage is the constitutional question behind it: Can sharp judicial remarks become grounds for impeachment under Article 124(4)? Legally, impeachment of a sitting CJI requires an extraordinarily high constitutional threshold — “proved misbehaviour or incapacity” backed by massive parliamentary support. Historically, very few impeachment motions against judges have even reached advanced stages. Yet politically and institutionally, the pressure is already building. Bar associations are demanding accountability. #CJIApologise is trending online. Retired judges and legal commentators are divided. The debate is no longer just about one courtroom remark. It is now about the limits of judicial language, institutional dignity, criticism of the judiciary, contempt law, activist litigation, and the future relationship between courts and civil society in India. One side says the CJI crossed the line. The other says the judiciary is under coordinated attack and finally pushed back.
