VA Dems representing the state argued SCOVA couldn’t legally decide before the referendum and succeeded in that legal argument. I was also annoyed it didn’t get dealt with pre-vote, but there was a basis for it and the legal basis was provided by D lawyers.

@KuviacM @steady_drumbeat This is exactly the same, the jumpers are the blues, if 50% or more vote red/dont jump, there will be less than 50% voting blue/jump, so those who vote blue/jump will die. In both scenarios, if no one votes blue/jump, no one dies

@steady_drumbeat The difference is that if no one jumps, no one dies, whereas voting red guarantees blues die. The analog would be "if you vote blue and get 50%, wood chipper will not kill anyone. if you vote red and 50% vote red, the wood chipper will mow through all blues"

NEW -- I just caught up with @SpeakerJohnson on FISA. I asked him about the trade some are proposing -- changes to warrant requirements for a longer FISA extension. "There's a few holdouts who have some ideas on what they think would be improvements to it ... so there's a lot of more thoughtful discussion going on this morning, so I'll know more about lunchtime." I asked JOHNSON if FISA needs to be changed to get it passed. "We might have to do some sort of minor modification."
