Private parties are being permitted access to the Consolidated Fund of the State, in violation of the Constitutional requirements of the Legislative approval before withdrawal of funds from the State exchequer – violation of Articles 203 and 204 This amounts to permitting APMDC to borrow upon the security of the Consolidated Fund of the State in violation of Article 293(1) of the Constitution of India Further, an exclusive charge is given to the Bond (NCD) holders of APMDC on all the future revenues of APMDC. Additionally, Government mineral wealth of value 1,91,000 crores is mortgaged to NCD (bond) holders. This is nothing short of cheating the people of the State. It is also known that in this regard, case is pending in the High Court of AP, which was admitted and notices were served on all the respondents to file counters. When the matter is sub judice, it is very inappropriate for the Government to allow APMDC to go ahead with the bond issuance. It is indeed very disheartening that the Government is acting with total disregard to the Constitution of India and the future of the State.
