The Federal Parliament of Somalia has formally reaffirmed that the Berbera Port concession entered into between DP World and the regional administration in Somaliland is constitutionally invalid and legally void. Under Somalia’s Provisional Constitution, foreign affairs, national security, and international commercial concessions fall exclusively under federal authority. Any agreement executed outside this framework violates Somalia’s constitutional order and undermines the rule of law. Recent geopolitical developments - including unilateral external recognition of Somaliland - raise serious concerns regarding regional stability, territorial integrity, and respect for internationally recognized borders. Somalia’s Constitution explicitly affirms that the nation’s sovereignty and unity are non-negotiable. The Federal Parliament emphasizes that continued commercial operations based on void authority risk legal exposure under Somali law and international legal principles governing state sovereignty and corporate responsibility. At the same time, Somalia remains open to lawful, transparent, and federally authorized investment. In this spirit, I have offered my good offices to facilitate dialogue between DP World and the Federal Government to regularize any investment under Somalia’s constitutional framework. The Federal Republic of Somalia calls on the United States and its partners to continue supporting constitutional governance, territorial integrity, and the rule of law in the Horn of Africa.
