I’m guessing this restraining order must have been granted, which would have forced Circle’s hand. It also allowed for service of summons and complaint by Discord message. Judges willing to freeze innocent bystanders in a civil suit are a pretty big risk that no one took seriously, and is hard to mitigate. I do seem to recall that @lex_node and I have muttered to people for years about divorce and bankruptcy cases being an underappreciated attack vector in DeFi. This is not those, but again, second time we’ve seen a civil case disrupt something in DeFi in the last month or two.

Banking incumbents want financial friction to persist so that they can keep extracting value from you. Stablecoins are a significant step forward in terms of providing universal access to USD with lower operational costs, higher transparency, lower systemic risks, and more competitive savings rates for consumers. The only person who is "full of shit" here is Jamie Dimon.

this is actually the important/potentially surprising part of the BTC perps approval makes a huge difference--swaps are much more regulated ! that being said, I expect many perps may still be swaps--especially perps relating to securities!

The importance of this approval is that the CFTC finally found that a true perp qualifies as a futures contract under the CEA (not a swap). As a reminder, what is a future is not specifically defined by the CEA; the definition of swap was added by Dodd-Frank /3

Remember what I said about TradFi weaponizing AML/KYC to kill real tokenization? In this interview Dimon repeatedly complained about stablecoins not having to conform to the same BSA requirements as banks, giving the example of money going to one wallet then another, "and the 2nd one may be a sex trafficker" JPM was Epstein's primary bank for 15 years.
