According to Asplin, Etherton et al arbitrage doesn't exist. But this is the barristers fault too because they don't understand the key finance aspects. On appeal it should have been a dawdle to overturn Asplin.

Despite legislation and case law,it appears that the mortgagee’s rights prevail. This explains why they refuse to further legislate to protect mortgagors from repossession and influence regulation

The fact is one is a home buyer with a mortgage and this is the true reality. When the Government states it wants one to buy their own house it is referring to one becoming a homebuyer as opposed to a homeowner. The curiosity in me asks why is that, then the penny dropped (2)
