In a move that has legal experts sounding the alarm, Donald Trump’s Justice Department is pushing a shocking new rule that could block state bar associations from investigating misconduct by federal lawyers. Talk about a “get out of jail free” card! Under the proposal, Attorney General Pam Bondi would gain the power to pause or derail ethics investigations launched by state bar regulators into current or former DOJ attorneys. Instead of independent state authorities reviewing complaints, Bondi could step in, seize control of the process, and force states to halt their investigations while the DOJ conducts its own review. If the DOJ decides its own lawyer did nothing wrong? The state investigation could effectively be shut down. Legal experts say that’s a massive and unprecedented intrusion into a system designed to keep lawyers accountable. Hilary Gerzhoy, who chairs the D.C. Bar’s rules review committee, didn’t mince words. She warned the proposal is “incredibly concerning” and flatly inconsistent with the long-standing principle that state courts — not the federal government — regulate attorney conduct. And critics say the timing is no coincidence. The proposal arrives as ethics complaints have piled up against DOJ officials involved in controversial Trump administration actions, particularly around aggressive immigration enforcement. Instead of allowing those complaints to proceed through the normal disciplinary system, the administration now wants the power to intercept them first. In other words: the Justice Department would be investigating itself — and potentially blocking anyone else from doing it. Legal advocates say the rule could also intimidate whistleblowers and people filing misconduct complaints. Kevin Owen, a whistleblower attorney, warned the proposal appears designed to identify and potentially target those who report wrongdoing. “This is about DOJ interfering with the states’ licensing authority of lawyers for the political benefit of this administration,” he said. Even more alarming, critics warn the proposal could allow investigations to simply stall forever. Without strict deadlines, the DOJ could run out the clock while misconduct allegations sit unresolved. The bottom line is simple. America already has a system to hold lawyers accountable — independent state bar authorities. But if Trump’s Justice Department gets its way, federal lawyers tied to the administration could suddenly find themselves operating under a very different rule: Accountability optional.
