Jean Carroll Case (the main relevant one) •This was a civil case (not criminal), so the standard was “preponderance of the evidence” (more likely than not), not “beyond a reasonable doubt.” •In May 2023, a federal jury in New York found Trump liable for sexual abuse (forcible digital penetration) and defamation of E. Jean Carroll related to a 1996 incident. They awarded her $5 million.22 •The jury explicitly rejected Carroll’s claim of rape under New York’s narrow legal definition at the time (forcible penile/vaginal penetration).2 •The presiding judge (Lewis Kaplan) later noted that the jury’s finding of sexual abuse aligned with the common, everyday meaning of “rape,” but this does not change the jury’s verdict, which distinguished the two.7 Appeals have been denied (including by the U.S. Supreme Court in 2026), so the verdict stands, and Carroll can collect the judgment (now over $5.8 million with interest).16 Other Context •Trump has faced multiple accusations of sexual misconduct, but no criminal conviction for rape or sexual assault exists. His only criminal conviction (as of 2026) is on 34 felony counts of falsifying business records in the New York hush-money case.10 •Civil liability is not the same as a criminal “guilty” verdict. In short: Liable for sexual abuse in one civil case (with a judicial note on common-language rape), but not found guilty of rape.
