In a firm rebuke to corporate complacency, the Court held that Safaricom PLC bears direct constitutional liability for a systemic data breach involving subscriber data, M-Pesa transactions, betting activity, device identifiers & geolocation records. The Court was categorical that privacy under Article 31 is not a corporate courtesy but a constitutional obligation.

The High Court has now rendered its judgment in the petition, finding Safaricom PLC liable for violation of the Petitioners’ constitutional rights to privacy and data protection arising from the impugned data breach. The Court has awarded the 11 Petitioners damages exceeding KSh 11 million for the infringement of their constitutionally guaranteed rights.

The Ministry of Interior and National Administration issued a notice requiring NGOs to transition to the Public Benefit Organizations (PBO) framework by May 13, 2026 or risk losing their legal standing. This directive comes against the backdrop of a High Court decision delivered on April 30, 2025 in Otieno & 2 Others v Attorney General & Another, where the Court found that mandatory re-registration under the PBO Act was unconstitutional. It held that compelling already registered organizations to apply afresh undermines the right to freedom of association and disrupts legal continuity. Instead, the Court directed that organizations validly registered under the previous regime should be transitioned automatically without fresh applications or additional fees. The current situation presents an important point of reflection on regulatory implementation. How do we align administrative directives with existing court determinations?

There is no longer such a thing as NGOs in Kenya. They will now be referred to as Public Benefit Organisations.The deadline for compliance with the new act is 13th May 2026.

Your claim is overstated. Some processed foods contain GM‑derived ingredients, but many do not. The US labeling system, the diversity of supply chains, and the existence of non‑GM verified products all contradict the idea that “pretty much any processed food” contains GM ingredients. The idea that most GM acreage is food or feed oversimplifies how GM crops are actually used. Yes, corn and soy dominate GM plantings, but a large share of that acreage is not grown for direct human consumption. Much of it goes into ethanol, industrial starches, biodiesel, lubricants, solvents, and other non‑food industrial uses. Even within the feed category, a significant portion of GM corn is grown specifically for ethanol production, with distillers' grains becoming a by‑product feed rather than the primary purpose of the crop. While corn and soy are technically food crops, the majority of GM acreage is not grown for human food. It is grown for fuel, industrial processing, and feed markets shaped by those industries. Calling all of that “food” stretches the definition past the point of usefulness. If someone wants to argue that GM crops are everywhere in the food system, that’s a different conversation. But the claim that most GM acreage is grown for food is not supported by how US agriculture is structured.
