Decided to go down a rabbit hole on Flock and actually read their TOS agreement and all the legal stuff on their website and its done nothing but reinforce my views on them (mass data collection and surveillance should be against federal law pursuant to the 4th Amendment).
Anyone that sells weather content or newsworthy video to media orgs knows what the section in yellow means. “You’re giving flock permission to use and disclose customer data in perpetuity.”
But I thought Flock doesn’t sell data to 3rd parties? Well, they have written their TOS to make it seem like they don’t sell our data outright but the underlined section is written as it is for a reason.
Basically even though data “ownership” is retained by the customer, the customer also gives Flock a free license to use your customer data in perpetuity (forever) for any manner that may improve Flocks products and services which is written extremely broad and vague on purpose. If they can use our data in any way to make them more profitable, then that’s improving their products and services. And they can continue to do this even if a customer terminates their agreement with flock. (They don’t have to own the data if they receive an irrevocable license in perpetuity to use it)
Combine this with their Feedback clause and you’ve got a business model that allows LEO’s to do certain things that normally would be protected by the 4th Amendment.
It also allows Flock to use LEO’s as corporate guinea pigs via any feedback received, in any manner, that they can use to better enhance their products which will also more importantly improve their balance sheet and their financial portfolio.
And for the people saying there’s no expectation of privacy in public, that is true, however that doesn’t mean I give a for-profit company my consent to monitor my movements enough so that they could build a product for LEO’s that contain a profile and pattern of life on anyone.
Wait until the next “pandemic” happens. If you thought the government forced lockdowns that destroyed so many small businesses in America were bad, with Flock and other companies like Leonardo with their SignalTrace integration, the next time there is a “pandemic” the amount of tyrannical government overreach will make Covid look like child’s play.
