President Trump announced he may eliminate gambling tax. Last night December 10th, Polymarket's odds of a repeal before March 31st, 2026 hit 55% at 8:30pm before falling back to 32% at the time of this tweet. There is a 42% chance before 2027.

@sprusfwitter Yea there's a few avenues I believe are viable. I was asked not to speak on it, and I believe its in the best interest of everyone that I don't as I want the best chance for this getting overturned as possible. I'd rather this get fixed then me screw the strategy over.

@FairBetTracker What are your thoughts on the provision being fixed by other means beyond the fair bet act? Seems like theres a lot of other avenues as well. And although I agree the Fair Bet Act has the most popularity Im just curious as you seem to only follow the Fair Bet Act.

Oh ok yes, Treasury could very possibly do that. Sorry, the word session had me thinking you meant through the legislative process and the 3+ months referencing an extended congressional section lol But yes Treasury could do this, and I had not considered this as im less familiar with the process.

So @repdinatitus tried to attach the Fair Bet Act provisions to a larger bill on defense spending as it was a must pass. The rules committee got to choose whether to attach it or not and they didn't. So what options do we have left in the 4th Quarter of 2026? Well we have 3 paths: 1. We can keep Fair Bet Act as a standalone bill. These standalone bills have a generally low pass rate historically. Around 1%-3%. I believe Rep Titus's persistence and other cosponsors of both parties bring this drastically higher, but as for how much higher, that's a tough estimate. 2. We can reattach it as part of other Must-Pass Legislations (bills with a near 100% need to pass rate such as defense spending). These bills become what is known as "omnibus" packages, where multiple policies get packed into one bill and one vote. The unfair tax was part of an omnibus bus, and we can undo it with an omnibus bill. As far as i'm aware we have a Government Funding Package and a 2026 Budget Resolution left regarding the major omnibuses. 3. We can pursue it via Senate Action. With Cortez-Masto and Rosen in the Senate supporting the FULL HOUSE Act (the senate version of fair bet), we have another opportunity there to skirt around the house rules committee's rejection. The Senate could include it in their reconciliation package. In the meantime @repdinatitus and other cosponsors can continue garnering support on both sides of the aisle and increase lobbying efforts.

@termnalguidance Yea I stated that in my defense of removing the tax. You’re 100% right on that handle dropping making their revenue net negative actually lol.

@FairBetTracker Minor factor in this but could have helped. The main point is that it won't be revenue positive as they project. Their projections assume static handle but handle will drop and / or shift offshore or to kalshi making their projections wrong

@Flupnolide @repdinatitus Go Hokies. Yes, I guess this could happen, but I would just categorize that as into the 2nd category, the must pass omnibus category, since omnibus bills usually trigger those, and the FAIR BET Act itself is unlikely to solely cause that.

Unfortunately, the GOP-controlled Rules Committee did not accept the FAIR BET Act as an amendment to the NDAA. This was an easy fix that should have been adopted. Nonetheless, I will continue to build support to restore the 100% gambling loss deduction.

The impact you have and jobs you are saving with this is underappreciated as the the detriment of the new tax law was underestimated. But the people of Nevada and in the gambling world know!

As I have many times, I stood in solidarity with them in their quest to ensure all our hospitality workers receive a living wage. They have been partners with @Teamsters and @NABTU in building better lives for working families.
