Please review the felony murder rule as to officers killed. Ashli Babbitt breached a barricaded door and was climbing through just a few feet from where Congress was being led in the evacuation of chambers. That presented an imminent threat of harm - especially when in context of the violent, bloody insurrection occurring.

Today, I journeyed to an obscure part of the Capitol basement to see the long-awaited plaque honoring the police officers who defended Congress and America against Trump’s insurrectionary mob on January 6, 2021. To his credit, Sen. Tillis joined Democrats in demanding it be put up, but this spot is not accessible to the public. Speaker Johnson, come on—put the plaque in its rightful place of honor.

Officer Sicknick’s death resulted from the events of J6, if not fully, certainly in part. The felony murder rule would apply. Whether the DOJ chose to charge under that law or not does not determine whether it is applicable or not. That is a legal determination. How they charge the crime is a charging determination.

Fascinating to read through these comments. It appears as though the majority don’t think the police who defended the Capitol against a several thousand rioters, in which many police officers were seriously injured and even killed. They think the police were the bad guys, Weeks ago you are the same people railing about how ICE deserves to be respected and if people would just comply they wouldn’t be shot in the street.
