Have you looked into this in Texas? We have regulatory and fraud enforcement failures, too. As an example, since you @tedcruz voted in favor of Frankenstein hemp-derived THC, what says you about the regulatory failure of industrial hemp in Texas? A 2025 review of 56 entities listed by the Texas Department of Agriculture (TDA) received in a FOIA request (see pic) as “industrial hemp farms” reveals systemic regulatory failure and a breakdown in basic verification and enforcement. Of the 56 listings reviewed: •3 businesses were permanently closed •3 were duplicate listings •3 listed incorrect addresses or cities •11 were not relevant or appropriate to be listed as hemp farms •16 were businesses primarily selling food, beverages, cosmetics, or vape products •5 were retail smoke shops In total, a majority of entities listed as “industrial hemp farms” were not legitimate agricultural producers, but instead retail or consumer-product businesses OR did not exist at all. This indicates: No meaningful vetting of applicants; No routine verification of physical locations; No enforcement of statutory distinctions between farming, manufacturing, and retail. It’s a registry that functions as a paper shield rather than an oversight tool. The result is a state-sanctioned registry that misrepresents retail THC sellers as agricultural producers, undermining food safety laws, consumer protection, and legislative intent. This is not a loophole. It is an ENFORCEMENT failure when more than half of Texas’ ‘industrial hemp farm’ listings aren’t farms at all, many are smoke shops, vape sellers, or closed businesses. That’s a regulatory failure. P.S. - Texas hemp oversight scandal: Sid Miller’s chief of staff Todd Smith was indicted, and later pled guilty, to felony bribery tied to selling access to hemp licenses, then was rehired by Miller to lead the same agency. Say whattttttt??? Who is actually growing hemp in Texas? What statutory or regulatory safeguards exist to ensure that “hemp grower” licenses are issued only to bona fide agricultural producers, and how often are those safeguards enforced? I emailed once about all elevators not working in a west campus 19th story building and his office sent a canned response referring me to 311 (which had also been contacted a few times). It took calling a fire battalion chief for the building to do something. The councilman is worthless.

Yes, this is a meaningful step. But it’s a “build the future capacity” move, not a “solve the crisis surge now” move. To truly impact crisis care quickly, you also need more inpatient beds, more step-down facilities, crisis stabilization units, substance-induced psychosis treatment capacity (and education, esp for young people), This is workforce pipeline funding, very important, but slow. Given you are pro-Frankenstein THC hemp that has sent so many Texans and others nationwide into cannabis induced psychosis, it’s sort of like having an arsonist promoting the hiring of additional firefighters.

Agencies can interpret ambiguous statutes If a law leaves gaps, agencies can fill them through rules esp for public health / controlled-substance risk issues. Counting THCA toward “total THC” aligns with federal USDA testing approaches which strengthens the state’s position. Because DSHS didn’t rely on just one argument, the retailers now have to defeat multiple legal foundations, not just prove one problem. To win, the Frankenstein THC vape shop would need to convince a judge that DSHS lacked statutory authority, that the rule is unreasonable or arbitrary, the science /enforcement justification doesn’t hold and the public-health rationale doesn’t justify the burden. That’s a heavy lift. Meanwhile, DSHS only needs the court to agree that at least one of its legal bases is valid then the rule can survive. Byeeeee, Felicia!
