PBO REGULATORY AUTHORITY (PBORA)
The Executive Director of Transparency International Kenya (TI-Kenya), Sheila Masinde, paid a courtesy call on PBORA Director General Dr Laxmana Kiptoo to discuss collaboration on developing a guide to support the NPO sector in understanding and managing Anti-Money Laundering and Countering the Financing of Terrorism (AML/CFT) risks. As part of the Kenya Non-Profit Organization Working Group, TI-Kenya is implementing an initiative aimed at addressing cross-border corruption and illicit financial flows to promote sustainable development. TI-Kenya has engaged Flywheel Advisory Consulting Limited to develop a practical Guide on Understanding the AML/CFT Risks for the NPO Sector. In line with the FATF Recommendation 8, Countries are required to assess and mitigate the risk of NPO misuse. This calls for NPOs to adopt risk-based AML/CFT measures, including donor due diligence, monitoring of fund flows, and reporting suspicious transactions, while safeguarding legitimate charitable activities.

In today's Standard newspaper, I argue that; 1. Once a judge has all the facts, all the issues, and the applicable law, there is only one legitimate direction; forward, through reason, to a conclusion that those inputs can honestly support. A judge who arrives somewhere else must explain how he got there, and the record must be capable of providing that explanation. 2. Decisional independence doesn't mean applying the law mechanically. It means applying the correct legal reasoning for the correct output. 3. Decisional independence is the freedom to reason. It is not the freedom to abandon reason. 4. Appeal corrects the error for the litigant but does nothing to hold the judge accountable for producing the wrong decision in the first place. @NelsonHavi @ehdande @ahmednasirlaw @joshuamalidzo @Ndonglaw043 @StandardKenya

JOINT PRESS STATEMENT: On Human Rights Violations Linked to Shanta Gold Operations in Siaya, Vihiga, and Kakamega Counties Voices from Ramula, Mwibona, and Ikolomani are not whispers-they are urgent cries for justice. A joint fact-finding mission by Haki Madini Kenya and partners has uncovered a disturbing pattern of human rights violations: lack of community consent, intimidation, misuse of law enforcement, and the tragic loss of lives due to excessive force. Communities are speaking of fear. Of being silenced. Of a system that appears to protect power over people. OUR DEMANDS: 🔴 Immediate suspension of Shanta Gold operations until full legal compliance 🔴 Respect for community rights, including free, prior, and informed consent 🔴 An end to police harassment, intimidation, and arbitrary arrests 🔴 Independent investigations and full accountability for all violations No investment should come at the cost of dignity, justice, and life. The Constitution must stand. The people must be heard. #FreeMeshackOmenya #FreeSilasAshitiba #Dropmaliciouscharges #ShantaGoldmustGo

#PressStatement Police killed two people in Gem-Ramula, Siaya, who opposed forced consent and eviction to allow Shanta Gold Ltd to mine gold from the area. Shanta Gold's apparent impunity suggests it has powerful state backing and acts as if above the law. All mining activities by Shanta Gold in Nyanza must be suspended because of gross human rights violations. Read more: khrc.or.ke/press-release/…

📊 𝐄𝐧𝐚𝐛𝐥𝐢𝐧𝐠 𝐄𝐧𝐯𝐢𝐫𝐨𝐧𝐦𝐞𝐧𝐭 𝐒𝐧𝐚𝐩𝐬𝐡𝐨𝐭 - 𝐊𝐞𝐧𝐲𝐚 (𝐎𝐜𝐭𝐨𝐛𝐞𝐫 𝟐𝟎𝟐𝟓 – 𝐌𝐚𝐫𝐜𝐡 𝟐𝟎𝟐𝟔) As Kenya gradually builds momentum toward the 2027 General Elections, the political landscape is becoming increasingly active - marked by realignments, rallies, and intensified grassroots mobilization. However, this period has also seen rising tensions, with concerns over political violence and the shrinking space for the protection of fundamental rights and freedoms. Despite ongoing efforts by civil society to engage duty bearers, independent findings including the Missing Voices 2025 Annual Report highlighted continued challenges such as: ⚠️ Crackdowns on civil society activism ⚠️ Restrictions on peaceful protests ⚠️ Heightened digital surveillance These developments are fueling public concern around accountability, transparency, and the integrity of government engagement processes. This report provides critical insights into the evolving governance environment and the implications for civic space in Kenya.
