@guidoacasa @unitetheunion Then that's what needs to be changed. How can a council licence an operator or vehicle in a controlled district that does not operate from there.

🚖 There are thousands of cabs operating on Wolverhampton plates all over the country. Your local council can't spot check the vehicle or the driver. This is 'cross-border hiring'. It undercuts the earnings of local drivers and it raises safety concerns for passengers. Nick, a Unite driver from Gatwick, explains more ⬇️

@UnitedCabbies There are 3 Acts of Parliament governing the private hire industry in England & Wales. 1. Private Hire Vehicles (London) Act 1998. 2. Local Government (Miscellaneous Provisions) Act 1976. 3. Plymouth City Council Act 1975. Are any of these Acts national, or are they all local?

The UCG have continually made Tfl aware of not just our concerns, but our members outrage that these apps are not geofencing. We have regularly provided photographic evidence. The Jump app geofences why aren’t the others . The UCG’s policy on this issue is Every single app that provides a Taxi should be geofencing and Tfl should be ensuring that they do.

@SirLesPatt2 It’s the App proprietor that is licensed to accept the booking, so it is pre-booked as far as the vehicle (with a driver) is concerned, prior to the booking being allocated to it by whatever means.

Asked TFL if yellow badges can pick up in the GB sector. Someone just called me and said they are NOT allowed even on an app. Can only pick up in their suburban area. Said to report any drivers along with their badge number date and time.

@Sammyscarf That's about contracting, and it's not London legislation. It's difficult, if you have a 'booking' defined, to then claim that the very limited detail that the driver is agreeing to is a booking, when you have Uber with the full details who you claim aren't accepting.

Booked or not? If you accept an app request, know pick up and destination is there anything to negotiate? If you respond to a street hail do you know the destination?

@Sammyscarf As the App providers don’t have manned operating centres in the controlled licensing districts they are licensed for outside London, what is the rule that determines whether they pay VAT or not.

@OfficialLSTC No clarification needed. Those who are ‘principal’ are liable to apply VAT, those who have agency are not (it’s the driver if they exceed VAT threshold). In London all operators are ‘principal’ outside they can still operate with agency model

@ianmarriott6422 @Sammyscarf You need to find out If the 1976 Act is to be interpreted as a national statute, or as a locally adopted Act applying only within each individual licensing authority’s jurisdiction. Then you have the answer.
