OUTRAGEOUS BEYOND BELIEF: @FBIDirectorKash's FBI is twisting the Trump administration’s $4.975 MILLION Ashli Babbitt wrongful death settlement to try to shut down her family’s FOIA lawsuit seeking the FBI’s own records on Ashli. Ashli Babbitt was the ONLY official homicide victim on Jan 6. Her family brought the wrongful death lawsuit that the Trump administration settled. Now 8 months later, the FBI claims the settlement somehow blocks the FOIA case. The FBI just told a federal court it “has been aware for several months” of the settlement but only “recently determined” it supposedly bars the FOIA case. But the settlement itself says it was “solely for the purpose of compromising disputed claims under the Federal Tort Claims Act.” In other words: wrongful death claims. Not FOIA. Will the abuse of Ashli and her family every stop?

This morning, my legal team, led by Jim Walden, filed a lawsuit against the City Council to permanently halt the ridiculous and unconstitutional disciplinary charges against me. These charges are based solely on my exercise of core First Amendment rights on my personal social media account here on X. To be clear about exactly what's happening, the City Council is trying to assert that the internal rules of our staff HR manual on 'workplace harassment' extend to the entire internet, so they can surveil and police speech they find 'offensive' or disfavored on social media and elsewhere. Needless to say this is an unprecedented attack on the First Amendment, essentially nullifying free speech protections for elected officials by giving any staff employee effective veto power over speech posted on social media. Public debate and discourse on controversial subjects would be limited and constrained to the point of being meaningless if this action is allowed to stand. Make no mistake -- what the City Council is attempting here has never been done before. At least not in the United States.   Of course, this policy is only being used against a member of the minority party. My lawsuit details multiple cases of Democrats who've said and done deeply offensive things without any discipline. One Council Member bit a cop during a protest over a homeless shelter in her district with no repercussions from the ethics committee. Another called @potus a “pedophile” during an official Council proceeding, in chambers and on the record. And the list goes on and on. No charges for these Members. Not even an official investigation.  This case is not only an unconstitutional breech of the First Amendment, but sheer hypocrisy as well -- and selective prosecution is also unconstitutional. I want to thank @jimfornyc for taking this case on, and I look forward to being vindicated in court.

I have taken a lot of heat through the years when I have criticized "state run news" in places such as King @GovNedLamont The Unaccountable's #Connecticut, saying that no such thing exists. Now we see an op-ed by @jahimes , a member of the U.S. Congress saying, not only does such a thing exist, he's damned proud it does, and he and others such as the @CTDems and the @CTSenateDems will continue to use their tax dollars to fund their viewpoint. Get it, kids? The First Amendment is a wonderful thing, except when someone expresses a viewpoint contrary to your own. In that case, you try to censor them and use their tax money for your reinforcement. I grew up as kid in the NY area reading the greats like Bob Lipsyte, Dick Young, Pete Hamill and Murray Kempton. On TV we watched Walter Cronkite and Howard Cosell. All had different viewpoints. But each of their endeavors stood on the genuineness of their message and on pure economics. Not state-sponsored support and encouragement to spew propaganda and not report on critical items impacting the general public if such report would be contrary to the interests of your glad-handing benefactor. People, lean on your legislators to stop the support of state-run media. If a thing cannot travel on its own economic merits, it should not travel at all.
