I'll say what I've been saying: if the DC Court of Appeals breaks their own rules to grant the ridiculous motion to stay the precedential value of the case, it's pretty much a guarantee they will rule against Benson en banc. And of course if they grant the en banc, that's a pretty big sign too obv.

This is a pretty legendary crashout by DC. An antigun jurisdiction loses just one hardware case, and: 1. They demand its precedential value be immediately stayed even before the court decides whether to en banc it (literally no precedent or rules exists to do that!) 2. They want the en banc decision be expedited and deny Benson even a chance to reply to the petition! 3. If the court ignores this DC will be flooded with magazines and everyone will die! They are pretty much trying to bully the court into granting en banc, I think. It's an excellent preview of New Jersey's crashout if they lose in the Third Circuit.

They scream in terror that California saw a surge in magazines during freedom week, and they need to prevent that. But California could point to no harm that resulted from that! And they later admitted in a different oral argument (Sanchez v. Bonta I think) that none did. The fact that DC has banned magazines over ten rounds so long is a reason to NOT stay this ruling - that constitutional violation has persisted long enough.

BTW, Boland/Renna was argued in August of 2023. Over two and a half years ago. Granted, it was stayed pending Duncan, and they asked for supplemental briefing on that ruling. But that briefing was done last May, plenty of time to have decided it since then. Don't know what the holdup is. I don't expect a good ruling, because our panel seemed to be 2-1 against us, but this was also just a preliminary injunction appeal, so not sure why they have to stall us so long. Just hand us our L if that's what it's going to be, and let us get on with final judgment. Could be that they are now waiting for Yukutake and Rhode, but there will always be some ruling to wait on. SCOTUS could grant cert in a hardware case for next term and then what, no Boland ruling until sometime after summer 2027?

This lawsuit is funny because it focuses in large part on advertisements (to try to get around the PLCAA), but Glock has maybe the most boring advertising of the big gun companies. Again, their beef isn't "irresponsible" advertising, whatever the hell that means. It's that gun companies get to advertise at all. And beyond that, that they get to exist at all in any capacity beyond selling guns to the government.

The Ninth Circuit is BIG mad about Judge VanDyke's latest dissent from denial of en banc rehearing. Yes, it certainly is provocative. I guess Judge VanDyke may have read "Plain English for Lawyers." But their outrage is misplaced. What they should be outraged at is this absurd situation. Biological men trying to force their way into a Korean spa that serves women and girls? Have we gone mad? I am not some hardcore anti-trans activist, and I criticized the rumors of a "trans gun ban" last year. But this is preposterous. Nobody should be able force their way into a place where women and girls are exposed and vulnerable, with the State of Washington assisting them no less! If a eyebrow-raising dissent helps this get attention (I certainly hadn't heard of this case before now), then good.
