@yinkanubi Tax is always an added cost. Always! No landlord will do what you just say. Rather, they increase the rent to include the WHT. Tax is always transferred to the final consumer. Again, always!

That work is not just collecting revenue; it’s communicating, educating, and simplifying until the woman in Uselu Market and the tenant in Magodo understand not just what they owe, but what they are supposed to get in return." I agree absolutely. Because you understand that the work is not only that of government, we the citizens must also be agents of communication and education of the tax laws while holding government accountable for what we contribute. Now let me address the letter from your landlord. I will do it in the form of a Q & A. 1. Who is supposed to withhold tax on rent? The landlord or the tenant? Answer: The TENANT withholds the tax, not the landlord. Under the tax law (old and new), WHT on rent is a collection mechanism, not a tax on the tenant. This means if your rent is N2m, you pay N1.8m to the landlord and remit N200k as WHT (to the State revenue service if the Landlord is an individual or the NRS if the landlord is a company). The landlord then receives the rent (net of WHT) and uses the WHT credit note to offset their PIT (if individual) or CIT (if Company). So in effect the WHT Credit helps the landlord to reduce his own income tax liability. It is legally incorrect for the landlord to demand RENT + WHT because he is indirectly asking you to pay for his tax credit. That letter in itself is self indicting but it can be understood from the position of lack of knowledge. 2. Is WHT on rent newly introduced in the new tax law or was it in the old tax law? Answer - WHT on rent has existed for decades in Nigeria under the Personal Income Tax Act (PITA), the Companies Income Tax Act (CITA), the Federal Inland Revenue Service (Establishment) Act and the State Internal Revenue Laws. So the landlord’s claim that this is “in line with the new tax policy” is misleading. 3. If this existed before, why is the landlord only requesting it now? Answer; IMO, (and please take this as just my opinion) there are three likely reasons, none of them legal justifications: - Fear of Enforcement. The new tax framework is heavy on expanding data matching, improvements in audit capability and increase in penalties for non-compliance. I perceive that many landlords who have not been paying PIT, CIT or have ignored WHT for years are now panicking. - Poor understanding of how WHT works. Many landlords wrongly believe “WHT is an extra tax the tenant must pay on top of rent.” That is false. WHT is deducted from their income, not added to it. - Cash-flow protection attempt. Some landlords now try to shift the tax burden to tenants, collect their full rent and still claim “compliance”. This is what you alluded to in your article. While a valid concern, it's still wrong and quite frankly risky for both parties. Again, I concede that many of them are doing it from a place of ignorance rather than deliberate attempt to evade tax. The biggest risk in all this is that even if you pay the RENT + WHT, the tax authorities still consider you as non-compliant and you are potentially liable to penalties in an audit. If I were to be the landlord, I would withdraw that letter and draft a new one saying; “In line with tax laws, you are required to deduct 10% WHT from the rent and remit same to the relevant tax authority, while paying the net rent to the landlord. Once remitted, please share the WHT with me so I can claim my tax credit”. Sorry for this long post, but I felt it was important to use your article to open up discussion on this very important issue you have raised. There is truly a lot of work to be done to educate people. It will be helpful if the guidelines from the tax authorities are out so we can refer to them when doing this. For my PhD thesis at SOAS University of London, I analysed all major civilian locations attacked by Boko Haram between May 2011 and December 2020. The analysis was based on data from the Nigerian Security Tracker (NST), compiled by the Council on Foreign Relations (CFR) in the United States. The data reveal that during this period, Boko Haram attacked 83 churches, resulting in 1,521 deaths, and 72 mosques, resulting in 2,017 deaths. The chart below, which forms part of my PhD thesis, presents the annual breakdown of these attacks—showing both the number of churches and mosques targeted and the corresponding fatalities recorded each year.
