The Court applied: ▪️Section 10 of the Equality Act – prohibiting words that are hurtful, harmful, incite harm, or propagate hatred. ▪️The Bill of Rights – balancing freedom of expression with the right to dignity and equality. ▪️International law – including ICERD (International Convention on the Elimination of All Forms of Racial Discrimination). ▪️Comparative law – examples from Canada and Germany where incitement to violence is criminalised. ▪️The EFF’s defence argued that the speech was metaphorical and rooted in revolutionary culture. The Court dismissed his testimony as misleading and unqualified. THE JUDGMENT Judge Sher’s ruling: ▪️Malema’s statements = hate speech under the Equality Act. ▪️His speech = direct incitement to violence against a racial group. ▪️The EFF is jointly liable, since it hosted and amplified his words. ▪️“Freedom of expression” was rejected as a defence – the Court emphasised that rights end where incitement begins.
