Securing the dismissal of federal criminal charges prior to trial is a challenging endeavor, but a federal judge in Memphis might do just that in the forthcoming decision on United States v. Kumar. This case involves Dr. Sanjeev Kumar, a Memphis-based doctor, who has been indicted on charges so baseless that I choose not to mention them here. I am privileged to be part of his defense team and to have dedicated my career to combating the misuse of federal laws and upholding justice. We have submitted two motions for dismissal. The first motion contests an interpretation of FDA regulations that would significantly broaden federal oversight of healthcare. DEA, DOJ and state AG prosecutions have had a chilling effect on controlled substance prescribing, and some courts have a misapplied a disjunctive interpretation of the CSA to make their job easier. AMA now has policy to support a physician with an amicus brief calling for a conjunctive interpretation. I want to see how this is put into real life, day to day practices in regard to opiates and pain care. We should never have been subjected to what we are living through today. At most we should have instituted a black box warning and a physicians' eyes only PDMP. #PainCareCrisis

With a heavy heart, this morning I joined the @FBI to honor and remember our fallen federal agents. We lost two FBI agents this year to illnesses related to their work on 9/11. We will never forget the bravery of these heroes who gave the ultimate sacrifice in the line of duty.
