Your daily reminder that Native Americans weren’t granted citizenship, of our own land, until the until Indian Citizenship Act was passed in 1924.

@CKDeGods @GeraldoRivera It says that one guy had an opinion about what the amendment ought to do based on a piss-poor understanding of the word "jurisdiction" even under its common meaning in 1868.

The president is right. The 14th Amendment was originally intended to embrace slaves and the children of slaves. Its passage in 1868, made it unconstitutional to deny citizenship to all children born here. Example: Despite odious attempts over the years to deny them, all Native Americans are (the original) citizens. So are all other babies who in Bruce Springsteen’s words were “Born in the USA.”

Attitude with a side of freckles
The issue isn't who is a citizen. The issue is whether the President can override the Constitution. And, no he cannot. If you want to change the Constitution, there's a way to do that. And, these assholes know they don't have the support to do it.

As everyone is focused on the SCOTUS hearing on @POTUS Executive Order ending Birthright Citizenship, I can’t help but wonder: Why hasn’t Congress passed a LAW ending birthright citizenship? We have a majority.

The job of SCOTUS is not to subjectively determine whether a law is stupid. Their job is to interpret the Constitution and rule on whether a law violates it. If MAGA wants to end birthright citizenship, they should pursue a constitutional amendment. If you don’t like the separation of powers our Constitution outlines, then leave the country. Your ignorance is anti-American and incompatible with the principles this country was founded on.
Cryptid Politics@CryptidPolitics

Birthright citizenship is stupid. My son was born in a foreign country. Do you think they gave him citizenship? Of course not. That country isn't dumb like we are. Birthright citizenship has got to be put to an end by SCOTUS.

If you really hate birthright citizenship, propose a new amendment to clarify that the 14th amendment applies only to the children of mothers here legally with the intention of long-term residence. I don’t know if that passes, but it absolutely has very real support.

The internet didn’t exist in 1791, but the First Amendment still applies. Modern guns didn’t exist in 1791, but the Second Amendment still applies. In the same spirit: illegal aliens and birth tourists didn’t exist in 1865, but the spirit and intent of the framers must be applied. The historical evidence is clear that they never intended for anchor babies to be a thing. That’s why they wrote “subject to the jurisdiction thereof” in the text and banned birthright citizenship from Indians, foreign visitors, and invading forces. Even the Wong Kim Ark case, which liberals have used to justify birthright citizenship since 1898, did not give citizenship to Indians or foreign ambassadors. It also doesn’t consider the modern understandings of immigration, illegal aliens, or tourists — because those things didn’t exist. Wong Kim Ark basically tried to say that children of immigrants are citizens (like Wong Kim Ark himself was). But tourists, guest workers, and foreign students aren’t immigrants. Neither are illegal aliens.
Eric Daugherty@EricLDaugh

🚨 JUST IN: Truly dangerous moment as Supreme Court Justice Ketanji Jackson suggests that newborn children of illegals would have allegiance to the US, even if their parents are illegal aliens How is she on the court? This is INSANE.

The court sketches of President Trump sitting in at the Supreme Court today as justices weighed his actions to limit 'birthright citizenship'. Trump is the first sitting President to attend proceedings. He stayed just about an hour and left during the defense's arguments. After court adjourned, Trump posted on Truth Social: “We are the only Country in the World STUPID enough to allow ‘Birthright’ Citizenship!” Actually, about three dozen countries, nearly all of them in the Americas, guarantee citizenship to children born on their territory, per Associated Press.

@ForwardCarolina @Orbital_Lexicon it’s not.The minutes from discussing the bill it was very clear alien births weren’t included as they weren’t subject to the jurisdiction.Similar to the indians who wasn’t made citizens when it was ratified. if the 14th meant all people, you wouldn t have needed a new law

@Orbital_Lexicon You're welcome to hold any opinion you like about how the U.S. Constitution should be changed (or not), but the point is that birthright citizenship is very clearly protected under it today.

Here's the thing: if you oppose birthright citizenship, that's an opinion you're allowed to hold. It's a free country. It means you support changing the United States Constitution, which very clearly and explicitly says anyone born on American soil is a citizen. But pretending that the U.S. Constitution doesn't say that, just because you don't like it, is a silly child's game. Birthright citizenship is a foundational principle of what America is all about, and no President, no matter how ignorant or delusional, is able to change that with the stroke of a pen. That's just not how America works. 🇺🇸
