The four were detained by security forces on Saturday as Biti led a delegation from the Constitutional Defenders Forum (CDF) an emerging coalition mobilising civic and political opposition to the government's planned Constitutional Amendment Bill No. 3 (CAB3). The arrests took place in Mutare's city centre, where the Constitutional Defenders Forum had convened a consultative gathering with residents of Manicaland province to explain the implications of the proposed amendments to Zimbabwe's supreme law. The CDF has been at the forefront of a growing civic movement that argues CAB3, if passed, would fundamentally alter the democratic architecture of the republic and clear the legal path for President Emmerson Mnangagwa to seek an extended presidential term beyond current constitutional limits the arrangement critics have labelled the ED2030 agenda. Biti, a senior figure in the Citizens Coalition for Change (CCC) and former MDC treasurer-general who served as Finance Minister in the 2009–2013 Government of National Unity, is one of Zimbabwe's most recognisable opposition voices on constitutional matters. The life of Parliament is not based on term limits, and under the Constitution, the President’s term runs concurrently with the life of Parliament. A referendum is not required to change the length of Parliament’s life. Therefore, if Parliament’s term is extended to seven years, the presidential term cycle may also be extended to seven years. According to constitutional interpretation, a “term” is defined as three or more years. This means that a two-year extension cannot be deemed a separate presidential term. Consequently, granting President Emmerson Mnangagwa an additional two years in office would not constitute an additional term limit, because two years does not legally amount to a “term.” Section 91(2), Zimbabwe Constitution (2013): “A person who has already served two terms as President is disqualified from election as President.” Section 328(7), Zimbabwe Constitution (2013): “An amendment to a term-limit provision does not apply to anyone who held office before the amendment.” This means extending the length of a term (e.g., from five to seven years) is not the same as removing the two-term limit, and does not automatically trigger a referendum Interpretation (Mupungu v Minister of Justice, 2021) The Constitutional Court clarified that extending the length of a term is not equivalent to altering the number of terms. Thus, a two-year extension does not count as a new term.

📌Opposition plots to disrupt CAB 3 public hearings A dangerous plot has been uncovered: opposition-linked formations are scheming to derail the Constitutional Amendment (No. 3) Bill public hearings of 2026. Job Sikhala’s National Democratic Working Group, Tendai Biti’s Constitution Defenders Forum, Jameson Timba’s Defend the Constitution Platform, and elements within the Citizens Coalition for Change have joined hands in a coalition bent on sowing chaos. Their plan is not debate but disruption mobilising groups across the country to violently interfere with proceedings, with figures like Morgan Ncube, Ralph Magunje, Watson Mushonga, and Bekhithemba Nyathi coordinating CDF efforts, while Joe Mugari and Tafadzwa Matekenya drive NDWG mobilisation. Amos Chibaya of CCC is alleged to have instructed provincial teams to assemble fifty youths per centre, funded by diaspora networks, to storm hearings and drown out dialogue. This is not democracy it is sabotage. Public hearings are meant to be inclusive platforms where citizens exchange views and shape the nation’s future. To turn them into battlegrounds is to betray Zimbabwe’s democratic spirit and tarnish its institutions before the world. The rule of law must stand firm, with the Zimbabwe Republic Police ensuring peace and order, and those who incite violence held accountable. Constitutional reform should unite, not divide; it should build dialogue, not destroy it.
