I'm perplexed as to why today's game is a 7:05PM start rather than a 1:05PM start. Yanks usually play their Saturday home games at 1, unless national TV is involved. Especially in April, when nights are very cold. And the night game tonight conflicts with the NCAA Final Four.

This is simply not my experience of New York. I've often heard people say, "You dropped something," and I've looked, and sometimes it was me! I've regularly done the same for others. I'm not afraid to look. Daniel and I live in the same city, but somehow we don't. This is not denying that street smarts are useful. We New Yorkers do tend to avoid eye contact until we've done a scan and scoped out that you seem mostly sane. A certain base-level alertness is wise. But every week, I encounter strangers and exchange little friendly moments. Sometimes it might be me and a dude sighing at running down the stairs and just missing the train. On another day, it'll be a few folks huddling under an awning in a fierce rainstorm and wondering to each other if we think it's letting up. And then there's the classic, help a lady up the subway stairs with her stroller. Yesterday, I'm picking up sushi from a takeout place. As I walk out, a guy says something I don't quite hear. I give the quick side-eye once-over, neat shoes, work clothes, seems solid, so I look up with a question on my face. He says, "I ate there yesterday, it's great!" I smile, "Yes, it is! Have a good one!" And we go off to our respective days, just a smidgen cheered by friendly contact with a stranger.

If somebody drops their keys in New York City, and you shout: “Hey, you dropped your keys,” most of the time they will not respond. People will not even check to make sure they have their keys. Because, as a matter of safety, New Yorkers are conditioned not to react when someone is yelling on the sidewalk, and certainly not to look at the person yelling. I understand why. I have turned in the direction of a lunatic screaming in the street and accidentally made eye contact, and I had to run away when he came after me. On a related note, the NYT editorial board has finally found some criminals they think should not have been released from jail: The January 6 rioters.

Giving that order is a war crime even if it's not carried out. But that is NOT an order @SecWar @PeteHegseth gave. And that is why you are full of shit. See, I've also trained hundreds of soldiers on LOAC in the applied context. Thousands, actually. And I've advised commanders & decision makers on LOAC in combat, in Afghanistan as Chief of International & Operational Law for CJTF-101/RC-E (OEF XIV). That's why I know the difference between what SECWAR said in a press briefing yesterday & a war crime. Apparently you don't - so I'll do you a favor & spell it out for you step by step, in simple language that you'll hopefully understand. Let's start off with what Hegseth ACTUALLY said: "It's a mess for them. Who's in charge? Iran may not even know. With every passing hour, we know and we know they know, that the military capabilities of their evil regime are crumbling. They can barely communicate, let alone coordinate; they're confused and we know it. Our response? We will keep pressing. We will keep pushing, keep advancing, no quarter, no mercy for our enemies." (war.gov/News/Transcrip…) Alright, if we consider this "no quarter" observation in context, we see Hegseth's intent is to convey that @DeptofWar is going to exert max pressure on our adversary. We know their military capabilities "are crumbling" & we're not going to back off. Keep pushing, keep advancing. "No quarter. No mercy." See, content & intent are important. This is how we differentiate political rhetoric from war crime. Reality from...bullshit. If we go all the way back to Hague, II (1899) & Hague, IV (1907), the Regulations annexed to both Conventions make it forbidden, "To declare that no quarter will be given" (pic 1, from Hague, IV). Seems legit, right? Isn't that what SECWAR just "declared"? Well, if LOAC development stopped at 1907, maybe you could make that argument. But, it didn't. In negotiations for later treaties, delegates decided to be more clear about what exactly that prohibition should entail. So, next we'll consider 2 later treaties 🇺🇸 hasn't ratified but we were deeply involved in shaping - Additional Protocol I (1977) to 1949 Geneva Conventions & Rome Statute @IntlCrimCourt (1998). As we'll see below, these sources confirm Hegseth's political rhetoric is NOT a LOAC violation or war crime...and US DoW doctrine is consistent with relevant text of these treaties. Let's start with AP I. As we see from art. 40, this treaty clarifies (7 decades after Hague IV), "It is prohibited to ORDER that there shall be no survivors, to THREATEN an adversary therewith or to CONDUCT hostilities on this basis" (pic 2). So, 3 specific verbs to highlight + 1 condition. No ordering, threatening, or conducting (verbs) armed hostilities under condition(s) of NO SURVIVORS. Now, reach all the way back in your memory - like 2 minutes ago - when you read actual text of Hegseth's remarks. Do you genuinely believe SECWAR just ordered or threatened there will be no survivors, even if an enemy IRGC member tries to surrender - or that we are now as a result conducting hostilities on that basis? Be honest. Of course not. And no one in the military is going to hear/read his remarks and think, "SECWAR just ordered me to take no prisoners." Seriously. Moving on from AP I, art. 8(2)(b)(xii) of Rome Statute essentially copies text of Hague IV, art. 23(d) to make "declaring no quarter will be given" a war crime (not pictured). BUT the elements of crimes follows AP I (pic 3), as does DoD Law of War Manual (pic 4). Yes, actual no quarter ORDERS do violate LOAC. Just the order alone is a war crime. But max pressure political rhetoric is not the same as an ORDER "that there shall be no survivors." Which means Sec Hegseth's comments are neither LOAC violation nor war crime. Which also means Rep Vindman is full of 💩.

My wife went to Lowe’s to buy a bathroom vanity. The sales person seemed confused when entering the order. The vanity never arrived at our new lake house in NH. Of course, the credit card charge went through and my wife paid it off in full. We didn’t really want the credit card, but the salesman pushed for us to apply for the Lowe’s credit card. So we did, and my wife paid it off immediately. For some reason, the bank canceled the credit card at the same time Lowe’s supposedly issued a refund. In order to get a refund, they had to watch videotape of my wife and I in the store to make sure we did not take the vanity with us in our car. Now my wife is out $1300. Synchrony Bank is forcing us to dispute the missing money, if they decide in our favor, the refund might happen within 60 days. We have to send them bank records and everything! Are you kidding me? Is this the way you run a business? I would love to hear from someone at synchrony Bank or Lowe’s to explain how this happens. Now my wife and I are about $1300 and neither your company or the bank will stand behind your mistake! Disgraceful! @Lowes @synchrony PLEASE share this to help my wife get her money back. 🙏🙏❤️❤️

A progressive sales tax broken down even into direct product markets is best. Example: buy a T-shirt for $50 or less it’s a 5% tax. Rich and buy a $300 T-shirt? 30% tax. Step up the tax all the way in between. 0% tax on basic food items, healthcare, etc. Rich pay more in raw dollars and % and can’t evade. Tax consumption (progressively like income brackets), not labor.
