The main problem with indicting Comey over "86 47" is that it's not self-evidently a threat. "86" has plenty of non-threatening meanings. During Biden years, it was used to mean impeachment. The second problem is that recent Supreme Court precedent means prosecutors need to show Comey had "some subjective understanding of the threatening nature of his statements." When informed of the potential threatening meaning, Comey said he didn't know that and deleted it.

BREAKING: Former FBI Director James Comey has been indicted again in relation to his "86 47" seashell post on Instagram last year, sources tell Fox's David Spunt. 86, in the restaurant world, means to get rid of or kill something from a menu, while 47 refers to the 47th president of the United States, President Trump. Comey was interviewed by Secret Service and federal investigators last year after the incident, though at the time no charges were filed. This is his second indictment, not even a year after his first indictment that accused him of lying to Congress about leaks to the press.

Comey: Well, they're back. This time about a picture of seashells on a North Carolina beach a year ago. And this won't be the end of it. But nothing has changed with me. I'm still innocent. I'm still not afraid. And I still believe in the independent federal judiciary. So let's go. But it's really important that all of us remember this is not who we are as a country. This is not how the Department of Justice is supposed to be. And the good news is we get closer every day to restoring those values. Keep the faith.
