@dilanesper The conservatives on the courts like the idea if there is a statute that will have the same result they wont invoke the 14th. I could see them using naturalization act of 1940 to recognize birthright citizenship but also saying executive orders cannot be used to impede statutes.

Prediction: the birthright citizenship case is 8-1 or 9-0 against the administration, on the constitutional issue. There's a lot of wishful thinking about "they'll make a statutory holding" but i think this will be a sweeping affirmation of the 14th amendment.

@BriannaWu I like to think there's a moderate constituency in wait of some leaders to grow a spine. If a candidate says "it's not hard: protect the integrity of women's sports, don't discharge trans soldiers who risked their lives for our freedom" I think most will nod.

I hate Transgender day of Visibility. Deciding to publicly come out as trans is the biggest mistake I ever made in my entire career. I believe we will lose all rights on this course and thought I could help move us to the center. But there’s no constituency for moderate public policy. I wish I’d just kept my mouth shut, enjoyed my life and my marriage and let all the nutcases leading our movement own their failure. Being trans literally does not affect my life because I did the work to integrate. That’s what every single sister should be focused on instead of this “Trans day of visibility” bullshit. Actual trans women want to make it to the other side.

@dcboron @WhyADuck2 @Milajoy Florida has early voting and mail in ballots but we require the mail in ballots due to elections office by 7 pm election day and we count them as they come in. So no late dumps and 90% of our mail in ballots are counted by the time the polls close.

The president has no role in the passage of a constitutional amendment, except the indirect one of using the bully pulpit. Congress passes the amendment by a 2/3 majority, then 75% of the states ratify. The AG's office can act on behalf of the president to interpret the amendment before the courts, but ultimately it is SCOTUS, not Congress or POTUS, who can define what the Amendment means.

Here is the move the Court might make: don't touch the Constitution at all. Congress enacted a statute in 1940 that grants birthright citizenship without any exception for parental status. If the statute controls, the executive order falls without deciding the constitutional question. @RegularRuben @rushicrypto A more humane and sensible version of property taxes would allow the government to put a lien on your property which would be claimed when your property is sold or you die. It would also allow the government to sell that lien. No foreclosure but also no giveaways.

@rushicrypto This is fine, but the government should t be able to take your home away if you don't pay property taxes. That's theft, and makes the tax very much tied to your home. Can't have it both ways.

I’m very confused about the number of people who think “property tax” is a sales tax on you home rather than taxes to pay for public services you use every day. “I paid off my home why do i still pay property taxes?!?!?” Oh, did you also stop using the roads and libraries and sidewalks and parks? @YZ_Kracker @hellovask @rushicrypto Having an asset is not the same as having wealth unless you can sell it. Property tax is essentially a wealth tax on the middle class and upper middle class.

@DMartinoLaw The even more narrow question is can the President redefine the 14th amendment by executive order...obviously the answer is no. Congress legislates on the matter according to section 5.

There’s no reading of that line that results in birthright citizenship only for some people and not others. Open and closed.

Have seen this framing numerous times now. SCOTUS is also about to consider rejecting the birthright citizenship order, and totally screwing our ability to decide who qualifies as a citizen.

This current scotus has used “historical precedent” in basically every single one of its ruling. The historical precedent, set by the original authors, paints a clear picture.
