As Commissioner @HesterPeirce notes, "the promise [of vaults] will only be realized... if we grapple now with the intersection between these asset deployment tools and the federal securities laws." This is why @crypto_council launched the Vault Coalition. Earlier this week, CCI and our Vault Coalition anchor members @galaxyhq @Morpho and @Bitwise met with SEC staff to begin that dialogue. We appreciate the opportunity to engage and look forward to continuing the conversation.

🚨NEW: Senator @RonWyden (D-OR) is asking Senate leaders to preserve the Blockchain Regulatory Certainty Act, as passed by the Senate Banking Committee, in any version of the Clarity Act brought to the floor. It comes amid uncertainty over whether certain key law enforcement groups will accept the BRCA language and whether changes will be needed to win their support, as well as the votes of other Democratic senators like Senators @CortezMasto and @MarkWarner. In a letter to Thune and Schumer, Wyden says the provision would codify existing federal policy by clarifying that non-custodial software developers should not be treated as money transmitters solely for publishing software, while preserving the DOJ’s and FinCEN’s ability to pursue illicit actors. Wyden was the Democratic co-sponsor of the standalone BRCA legislation in the Senate alongside @SenLummis.

Illinois has been a financial hub for generations. This punitive tax puts that at serious risk. The immediate impact unfortunately falls on IL residents who use digital assets. The bigger story: with ~67 million Americans using digital assets, responsible digital asset activity will simply move to the states actively competing for the industry. Outcome: Illinois loses the jobs, the innovation, the businesses, and yes, the tax base and tax revenue.

Illinois lawmakers have placed the future of Chicago as a financial market hub at risk by instituting a “sin tax” on blockchain technology. The decelerationist law goes so far as to tax transfers of crypto assets that generate no economic gain. Subjecting Illinois residents to property ownership by permission rather than right. As blockchain technology continues to transform our markets, the choice to plunder crypto wallets rather than promote economic growth may go down in history as Chicago’s last trade. Today, the CEOs of the @Crypto_Council, @Blockchainassn, and @DigitalChamber sent a letter urging the House Ways and Means Committee to pass @RepMikeCarey’s H.R. 9175, the Tax Clarity for Mining and Staking Act, as introduced. For years, miners and stakers have faced uncertainty regarding the timing, sourcing, and character of tokens created through network validation. H.R. 9175 would provide long-needed clarity on the federal tax treatment of digital asset mining and staking rewards. The ABA published a piece this week arguing staking rewards should be taxed like bank interest. I testified before @WaysandMeansGOP last July on this exact question and I want to be direct: the analogy is wrong, and the tax policy implications matter. Bank interest arises from a bilateral contract. A borrower takes your capital, pays you a return, on a known schedule, at a certain value. Staking rewards have none of that. They’re newly created tokens issued by a protocol. There is no counterparty, no payment schedule, real slashing risk, and often no liquid market at the moment of receipt. Taxing them identically isn’t neutrality. It’s a category error. The ABA also misreads the Tax Clarity for Mining and Staking Act. The bill doesn’t eliminate the tax obligation, it creates an optional election to time it to disposition, when economic value is actually realized. That’s how you tax something accurately when the value at creation is genuinely uncertain. And the competition argument that staked assets will pull capital from bank deposits is a stretch at best. Even if it wasn’t that would be financial stability concern, not a tax policy argument. The right venue for that debate is prudential regulation, not the tax code. Parity means equal treatment of similar activities. Staking rewards and bank interest aren’t similar. Forcing new technology into a framework designed for a different economic reality isn’t fairness - it’s incumbency protection wearing the language of fairness. Tax policy is finally getting its moment. The House Ways & Means Committee’s first full legislative hearing on digital asset taxation is now underway. With multiple bills recently introduced, the conversation has shifted from identifying problems to evaluating solutions. As @LawrenceZlatkin just said, "when tax rules are clear, people comply.” In the room and looking forward to the discussion.
