Trump's fix: switched to Section 122 of the 1974 Trade Act (real law Congress passed). - Allows up to 15% surcharge on ALL imports (he's doing 10%). - ONLY for "balance-of-payments" issues (trade deficits messing with dollar/payments). - Strictly temporary: max 150 days, then Congress must act or it ends. - Never used before, but it's explicitly legal (unlike the emergency one SCOTUS killed). 3. Bottom line: This is a narrower, statute-based workaround—not the same thing the Court struck down. It's following rules Congress set, with built-in limits & time cap. Still bad policy?
