@ThinkAppraiser Litigation finance is big business. It would be unethical for their attorneys to make the loans. I doubt that’s the situation.

Was talking to the sellers of this house and they mentioned that the wife is going to come into approximately $4 million from a huge settlement They also mentioned that some attorneys that they’ve been dealing with have already offered them money upfront in the form of loans before the payout comes It sounds like this family is already over $100,000 in debt to some attorneys before they get their payout I’m wondering how common that behavior is because it sounds highly unethical

@HopsLaw @DougKyed How is the play not over in image 2 if he’s touched in image 1? So you’re making up a new rule that he HAS TO SURVIVE THE GROUND AND A 3 MISSISSIPPI COUNT WHILE A DEFENDER RIPS AT THE BALL? Lol. That’s not the rule. “Play not over when touched” that’s a new one too.

I understand why Bills fans don't want to understand why it's not a catch. They're emotional and invested. It's natural. They're quite literally coping. I genuinely don't understand how anyone who is not a Bills fan does not understand that Cooks didn't survive the ground. It does not matter that for a fraction of a second his knee is down, and he was touched. That's not the rule. The moment he hit the ground, he lost control, and the ball wound up in McMillian's arms.

@ryKeough @DougKyed The play is not over when he is touched. If the ball comes out at that point and isn’t possessed by the defender, it’s incomplete.

You say the moment he hit the ground he lost control — That is just not true and disingenuous by you. This is the moment he hits the ground. Catch. Shin/knee down and touched. Play is over. But you say this doesn’t matter? Lol. The 2nd image shows he survives further & still has ball.

@DougKyed Because he literally did survive the ground. His knee touched the ground while the defender was touching him thus he’s down by contact. He then rolls over and the db rips the ball out. The ground didn’t cause the loss of the ball, the defensive players did after he was down

Investment Fund Key Terms, Part 21: LP Giveback ↩️ An LP giveback is an obligation of limited partners (and, to be fair, the GP) to return prior distributions to the fund. ➡️ Why would an LP need to return distributions? The LP giveback comes into play when the fund needs to pay something…but the fund doesn’t have sufficient reserves, and each LP is fully funded (their uncalled commitment is $0). These payments might include the following: • Fund-level indemnification obligations • Litigation judgments or settlements • Unpaid fund expenses or liabilities • Liabilities in connection with the sale of investments (such as breaches of reps or warranties) ➡️ What are the limits on LP giveback obligations? Most LP giveback provisions are limited. Market-standard protections include: ✔️ Cap by commitment (often 20–30% of total commitment) ✔️ Cap by distributions received (i.e., you can’t be forced to return more than you’ve actually received) ✔️ Sunset period (commonly 2–3 years after distribution or 2-3 years after the fund’s term ends) In some cases, these limits are waived for funds investing in other funds, if the liability arises from the underlying fund investment’s own LP giveback requirement. Here’s what an actual provision might look like: 💬 Each Limited Partner shall, upon written notice from the General Partner, return to the Fund such portion of any distributions previously received by such Limited Partner as is reasonably necessary to satisfy the Fund’s indemnification obligations or other liabilities. Notwithstanding the foregoing, the aggregate amount that any Limited Partner may be required to return pursuant to this provision shall not exceed the lesser of (i) twenty-five percent (25%) of such Limited Partner’s Commitment and (ii) the aggregate amount of distributions previously received by such Limited Partner from the Fund. No Limited Partner shall be obligated to return any distribution made to such Limited Partner after the third (3rd) anniversary of the date on which such distribution was made. ⏩ Next up in Part 21 – Management Fees

Marriage, starting a family, raising kids, divorce, failed relationships, etc. It is very important that we do not strictly define success as material. Prevailed on some motions filed by a counterparty in an ongoing case. Spent a lot of money doing so. I asked my attorney if we might recover any attorney’s fees. He seemed doubtful. Just got a bill for 5 grand for work on a motion to request attorney’s fees. I feel like I should have been asked before running up these hours in a possibly fruitless attempt to recover other hours. I also feel like this is a lot of hours for what seems like a simple request. Am I wrong?

Just received tenant’s lawyer’s requested addendum to a lease which (we had already negotiated…) Among 9 insane requests: 1) no late fees unless rent is unpaid 15 days after I provide notice of delinquency in writing… 2) I waive all future claims against their company due to their company’s negligence 🤣 3) if any utility goes down for any reason they don’t owe rent 4) I waive all right to remedy if they default on their lease if I eventually find another tenant Each one of their 9 requests is a first for me across 27 industrial suites… bananas
