Passed FISA to protect Americans🇺🇸 “There’s a fundamental misunderstanding of this program. Warrant requirements are created under the Fourth Amendment. They apply inside the United States. This is not a program that operates within the boundaries of the United States. It targets foreign nationals outside the United States. … Mr. Speaker, let’s put America’s safety first.”

FISA Section 702 is one of the most critically important national security tools we have. As a former FBI Special Agent, former federal prosecutor, and Chairman of the House Intelligence Committee’s CIA Subcommittee, let’s break this down clearly: Collecting evidence is NOT the same as querying information that has already been lawfully collected. What is being proposed is unprecedented in our nation’s history, unworkable in practice, and dangerous in consequence. A warrant requirement for lawful 702 queries would bury the courts, paralyze urgent intelligence and law enforcement work, and push us back toward the same dangerous pre-9/11 posture that left agencies unable to connect the dots before it was too late. We should always improve oversight. Yes. We should always protect civil liberties. Yes. We should always demand accountability. Yes. But we cannot afford to misunderstand the tool, misstate the law, or weaken one of the most essential capabilities we have to find threats, stop attacks, and keep the American people safe.

FISA 702 is a critical national security tool that equips our military with the best intelligence to keep Americans and the homeland safe. The Senate MUST ACT immediately and pass the bipartisan House-passed legislation that reauthorizes this vital authority before it sunsets tonight at midnight.

The importance of the FISA 702 authority to U.S. national security cannot be overstated. While no one in Washington can get 100% of what they want all the time, this bill makes measurable reforms to strengthen oversight and accountability, while maintaining the criticality of this national security tool. Many of us understand the significant advantage 702 provides to U.S. national security and the fervent need to protect Americans’ privacy and civil liberties. We should not sacrifice one for the other, and this legislation, passed by the House, strikes that balance. I urge our colleagues in the Senate to take up the House-passed bill immediately and send it to President Trump’s desk for signing.

This is not just about corrupt money making.  This type of activity directly puts U.S. forces going into harms way at risk.  Our adversaries are highly adept at putting together the mosaic of data points in the open to assess our potential actions, and this – in addition to being financially corrupt – was a willful breach of all operations security standards to protect forces going into action.   Thanks to the @TheJusticeDept and the @FBI for their quick action to reach accountability.

With this legislative proposal, Congress is building on these reforms by making real enhancements to privacy protections for Americans, increasing accountability for abuses, and providing for a first-ever external review for the primary source of past abuses – the FBI. It’s been made abundantly clear that no option will be 100% perfect in the eyes of everyone, but this bill makes measurable reforms to strengthen accountability and safeguards, while maintaining the criticality of the national security tool. At this point in the debate, many in Congress understand the significant advantage 702 provides U.S. national security, and the fervent need to protect Americans’ privacy and civil liberties.
