BAF Demands Urgent Action, Tables KAOMA Without Delay Bengaluru The Bangalore #Apartments Federation (#BAF), representing over 1,400 Resident Welfare Associations (RWAs) and approximately 1.5 million citizens, has issued a strong ultimatum to the State Government, demanding the immediate tabling and implementation of the Karnataka Apartment Ownership and Management Act (#KAOMA) during the upcoming #Belagavi Assembly Session. BAF argues that the State must urgently update the “archaic” Karnataka Apartment Ownership Act of 1972. They claim the current “legislative vacuum” is causing administrative chaos and extensive litigation due to the absence of clear management and ownership rights for apartment dwellers. At a press conference today in #Bengaluru, BAF President Mr. Satish Mallya stated that the implementation of a comprehensive legal framework has been BAF’s primary demand for years. “Implementing a comprehensive legal framework for apartment owners has been BAF’s primary demand for years,a commitment both the Congress and BJP included in their manifestos. With two and a half years elapsed since the Congress Government took power, this is no longer a mere request but an urgent legislative demand. The delay, the legal vacuum, and the lack of clarity have severely impacted lakhs of homeowners who deserve protection,” said Mr. Mallya. BAF’s detailed proposal for KAOMA urges the government to include several non-negotiable provisions to provide clarity and protection for residents, including: - Ensuring the clear transfer of property rights and Undivided Share (UDS) from builders/promoters to owners. - Strengthening Owners’ Associations with clear rules for formation, registration mechanisms, and enforcement of bye-laws. - Establishing a dedicated and swift mechanism for conflict resolution. - Including provisions for the amalgamation and redevelopment of aging apartment complexes. - Consolidating governance under one comprehensive KAOMA, replacing the current fragmented system that relies on multiple laws. BAF General Secretary Mr. K. Arun Kumar highlighted the perceived inaction, noting that it has been almost two years since Deputy Chief Minister D.K.
